esiding in the country. <strong>The</strong> new identity documents are produced in full compliance<br />

with the European Union standards. <strong>The</strong>y have all levels <strong>of</strong> protection against<br />

counterfeiting and mala fide usage. <strong>The</strong> adoption <strong>of</strong> this statute is a stage in the<br />

harmonization <strong>of</strong> <strong>Bulgaria</strong>n national legislation with the <strong>migration</strong> legislation in Western<br />

Europe. <strong>The</strong> term “passport” is used only with regard to travels abroad, while, similarly<br />

with the situation in the countries <strong>of</strong> the Schengen Agreement, the “identity card” shall<br />

be used by the citizens <strong>of</strong> the Republic <strong>of</strong> <strong>Bulgaria</strong> to prove their identity on the territory<br />

<strong>of</strong> the country.<br />

<strong>The</strong> Civil Registration Act <strong>of</strong> 27 July 1999 regulates the terms and procedure for civil<br />

registration <strong>of</strong> all <strong>Bulgaria</strong>n citizens, foreigners permanently staying on the territory <strong>of</strong><br />

the Republic <strong>of</strong> <strong>Bulgaria</strong>, individuals having refugee or humanitarian status and<br />

individuals who have been granted the right to asylum on the territory <strong>of</strong> the Republic<br />

<strong>of</strong> <strong>Bulgaria</strong>. In addition to that, two more statutes should be mentioned. <strong>The</strong>se are the<br />

Administrative Services for Natural Persons and Legal Entities Act regulating the<br />

organisation <strong>of</strong> administrative services, and the Personal Data Protection Act regulating<br />

the protection <strong>of</strong> natural persons with regard to the processing <strong>of</strong> data and access to the<br />

latter.<br />

Other statutes <strong>of</strong> importance for the foreigners in the country are the Administrative<br />

Procedure Act <strong>of</strong> 13 November 1979 and Administrative Violations and Penalties Act <strong>of</strong> 28<br />

November 1968. <strong>The</strong>se contain basic rules regarding administrative actions and<br />

imposition <strong>of</strong> administrative sanctions.<br />

<strong>The</strong> Judicial System Act <strong>of</strong> 22 July 1994 and Supreme Administrative Court Act <strong>of</strong> 19<br />

December 1997 expressly envisage that only individuals having solely <strong>Bulgaria</strong>n<br />

citizenship may apply for job in these structures. <strong>The</strong>refore, certain <strong>of</strong>fices in the state<br />

are preserved exclusively for <strong>Bulgaria</strong>n nationals, which by no means infringe<br />

foreigners’ rights and freedoms.<br />

<strong>The</strong> Asylum and Refugees Act (ARA) <strong>of</strong> 31 May 2002 provides for the types <strong>of</strong> specific<br />

protection, procedures and conditions for granting it to foreigners on the territory <strong>of</strong> the<br />

Republic <strong>of</strong> <strong>Bulgaria</strong>. <strong>The</strong> statute, that entered into force on 1 December 2002, regulates<br />

the procedure for granting refugee status, determines the rights and the obligations <strong>of</strong><br />

the refugees, as well as the state bodies and their terms <strong>of</strong> reference with regard to the<br />

protection <strong>of</strong> the refugees in the Republic <strong>of</strong> <strong>Bulgaria</strong>. <strong>The</strong> provisions <strong>of</strong> the act pay<br />

special attention to individuals with specific needs – women and unaccompanied<br />

minors. ARA meets the European criteria and standards in the sphere <strong>of</strong> asylum. <strong>The</strong><br />

effective implementation <strong>of</strong> its provisions is one <strong>of</strong> the basic priorities in the National<br />

Programme for Adoption <strong>of</strong> the acquis <strong>of</strong> the EU (NPAA). <strong>The</strong> Act establishes a strong<br />

legal base regulating the questions connected with application for and granting <strong>of</strong><br />

refugee status, as well as with the appeals against refusal to grant such a status.<br />

<strong>The</strong> Asylum and Refugees Act is in compliance with the basic international instruments<br />

– the United Nations’ Geneva Convention on Refugee Status <strong>of</strong> 1951 and the New York<br />

Protocol on Refugee Status <strong>of</strong> 1976, and the European Convention on Protection <strong>of</strong><br />
