• <strong>The</strong> statute also reflects the Council Resolution <strong>of</strong> 30 November 1994 concerning the<br />
restrictions on admission <strong>of</strong> citizens <strong>of</strong> third countries on the territories <strong>of</strong> the<br />
member-states with the aim <strong>of</strong> carrying out freelance activity (396 Y 0919 (03),<br />
because its provisions regulate the terms and procedure for obtaining <strong>of</strong> permission<br />
for a long-term stay with the aim <strong>of</strong> carrying out freelance activity, and also define the<br />
meaning <strong>of</strong> “freelance activity”;<br />
• In the Council Recommendation <strong>of</strong> 22 December 1995 on coordinated action and cooperation<br />
in implementation <strong>of</strong> expulsion measures (396 Y 0110 (02)) it is envisaged<br />
that the state bodies exercising authorized activities in connection with the<br />
conditions and the order <strong>of</strong> entering, stay and leaving the Republic <strong>of</strong> <strong>Bulgaria</strong> by the<br />
foreigners interact with the competent bodies <strong>of</strong> other countries in the fight against<br />
illegal <strong>migration</strong> and in carrying out expulsion;<br />
• <strong>The</strong> Act envisages legal possibility for reunion <strong>of</strong> divided families, in accordance with<br />
the express recommendation <strong>of</strong> the European Commission;<br />
• With the aim <strong>of</strong> strengthening the control over the foreigners residing in the country,<br />
the latter must declare in writing the address where they stay in the Republic <strong>of</strong><br />
<strong>Bulgaria</strong>, as is the practice in a number <strong>of</strong> European countries. In order to make the<br />
control mechanism more effective, the Act envisages an obligation for a person,<br />
granting a place to live to a foreigner, to inform the authorities exercising<br />
administrative control <strong>of</strong> the foreigners, for such circumstances;<br />
• With the aim to achieve greater harmony between domestic legislation on foreigners<br />
and basic international conventions for protection <strong>of</strong> human rights and freedoms,<br />
ratified by <strong>Bulgaria</strong>, the Act introduces a prohibition on the expulsion <strong>of</strong> foreigners in<br />
cases where they are to be sent to a country where their life and freedom are<br />
endangered and they may be subjected to a danger <strong>of</strong> prosecution, torture or<br />
inhuman or humiliating treatment;<br />
• Another important rule is that as an exception, when required by the state interest,<br />
by extraordinary circumstances or by humanitarian reasons, as well as in the cases<br />
admitting no delay, or if so stipulated by a ratified international agreement in force for<br />
the Republic <strong>of</strong> <strong>Bulgaria</strong>, the bodies <strong>of</strong> border passport control at the border<br />
checkpoints can, in coordination with the <strong>of</strong>fices for administrative control <strong>of</strong> the<br />
foreigners, or with Consular Relations Directorate <strong>of</strong> the Ministry <strong>of</strong> Foreign Affairs,<br />
issue single entry visas for airport transfer, transit passing, and short term stay for a<br />
period <strong>of</strong> 10 days;<br />
• <strong>The</strong> statute precisely enumerates the conditions under which the bodies <strong>of</strong> border<br />
passport control may revoke issued visas. In such cases they inform with no delay the<br />
Ministry <strong>of</strong> Foreign Affairs.<br />
According to the Foreigners in the Republic <strong>of</strong> <strong>Bulgaria</strong> Act, a foreigner may enter the<br />
country at the defined border control checkpoints. <strong>The</strong> individual must have valid<br />
documents for travel abroad, visa if it is required, as well as the necessary financial<br />
resources to stay in and leave the country, and the mandatory insurance.<br />
Foreigners may stay in the Republic <strong>of</strong> <strong>Bulgaria</strong> for a short term or a long term. <strong>The</strong><br />
short-term stay is up to 90 days from the date <strong>of</strong> entering the country. <strong>The</strong> term may be<br />
extended by the services for administrative control <strong>of</strong> foreigners due to reasons <strong>of</strong><br />
humanitarian character.
