The Contract completion time will be adjusted only for causes specified in<br />

paragraph 15. Time extensions will be granted only to the extent that equitable<br />

time adjustments for the activity or activities affected exceed the total or remaining<br />

float along the critical path at the time of actual delay. Delays in activities<br />

which are not on the critical path and do not affect Contract completion dates,<br />

will not be considered for an extension of time.<br />

15. CAUSES FOR EXTENSIONS OF TIME. Additional positive total float in the<br />

Progress Schedule generated by efficiencies of District or Contractor is a shared<br />

commodity to be reasonably used by either party, and belongs exclusively to<br />

the Project. The Contractor is not entitled to any additional compensation for<br />

completion of the project prior to expiration of the Contract Times.<br />

15.01. District-Initiated Changes. District initiated changes to the Contract work<br />

that absorb float time will not be considered for an extension of time. Districtinitiated<br />

changes that affect the critical path of the Progress Schedule shall be<br />

grounds for extending or shortening completion dates. Use of float time for<br />

Contractor initiated changes will require District's concurrence. Contractor's<br />

changes, however, shall give way to District-initiated changes competing for<br />

the same float time.<br />

15.02. Outside Contractor's Control. Events outside of the Contractor's control<br />

that affect the critical path of the Progress Schedule will be considered for an<br />

extension or reduction of the Contract Times.<br />

15.03. Weather Delays. District Representative will obtain weather data during<br />

construction from a reputable source, and will maintain weather records.<br />

District Representative will determine Contractor's entitlement to an extension of<br />

the Contract time as a result of weather delays, based on the flow chart on<br />

Figure 1-01310 and the data included in Tables 1 and 2. Extensions of time will<br />

be granted at the discretion of the District Representative for circumstances not<br />

covered by the flow chart.<br />

Any weather-related extension of Contract time shall be non-compensable.<br />

Efficiencies gained as a result of favorable weather within a calendar month,<br />

where the number of days of normally anticipated weather days is less than<br />

expected, shall contribute to the project float and shall not affect the Contract<br />

Times.<br />
