Mr. Gregory motioned for approval, and Dr. Frederick wanted it in the record that the project
was being approved without receipt of FWC and USFWS approvals as stated in the item. Mr.
Green questioned whether the motion was for approval to the consent agenda, and Mr. Gregory
responded yes. Mr. Gelhardt seconded the motion and item approved unanimously to be
placed on the consent agenda.
ARC ACTION: Mr. Gregory moved that this item be placed on the consent agenda for
approval. Mr. Gelhardt seconded the motion. By a unanimous vote the motion was
approved.
ITEM 17: REQUEST: Consideration of (1) a determination in accordance with Article X,
Section 18, Florida Constitution and Section 253.034(6), Florida Statutes, that a 0.22acre
parcel of state-owned property that is part of the St. Augustine Historical District
and is currently under the management of the University of Florida is no longer needed
for conservation/historical purposes and (2) a determination in accordance with Rule
18-2.018(3)(b)1.c., F.A.C., that the Board of Trustees of the Internal Improvement Trust
Fund of the State of Florida’s conveyance of the 0.22 acres by gift to the City of St.
Augustine provides a greater benefit to the public than its retention in state ownership.
DISCUSSION:
Mr. Ed Poppell, University of Florida, spoke to the Council stressing the importance of gifting the
property to the City of St. Augustine.
Mr. John Regan, City Manager of City of St. Augustine, spoke on behalf of the St. Augustine
City Commission. He wanted ARC to agree to make the property a pure gift without stipulation
for equal value in return.
Ms. Deborah Poppell, DSL Director, explained that the DSL has responsibility to the Board of
Trustees and that the Board will determine whether the property is conveyed by donation or
exchange.
Mr. Stroh discussed the historical significance on a state and national level. The visitor
orientation center will be of educational benefit to the public. It will be a state of the nation
structure.
Dr. Frederick wanted the agenda modified to reflect that the property is still needed for historic
purposes.
Mr. Scott Woolam, Chief, Bureau of Public Land Administration, stated that the constitution
requires a finding of no longer required for conservation purposes.
Mr. Gelhardt, DCA, wanted to know if they could recommend that the City pay for the parcel.
Dr. Frederick stated that ARC has to leave compensation to the Board.
Mr. Cochran, FWC, concurred with amending part two of the agenda because the wording
indicates that ARC is recommending gifting.
Dr. Greg Brock, Office of Environmental Services, DSL, recommended specific wording to
amend the agenda item.
ARC ACTION: Peter Frederick moved that this item be approved with the following
