ITEM 16: REQUEST: Consideration to ensure that a 3.23-acre stormwater drainage and
maintenance access easement to Brevard County within the Helen and Allan
Cruickshank Sanctuary is in compliance with the Board of Trustees’ Incompatible Use
of Natural Resource Lands Policy.
ARC RECOMMENDATION: Approved on consent.
ITEM 17: REQUEST: Consideration of (1) a determination in accordance with Article X,
Section 18, Florida Constitution and Section 253.034(6), Florida Statutes, that a 0.22-acre
parcel of state-owned property that is part of the St. Augustine Historical District and is
currently under the management of the University of Florida is no longer needed for
conservation/historical purposes and (2) a determination in accordance with Rule 18-
2.018(3)(b)1.c., F.A.C., that the Board of Trustees of the Internal Improvement Trust Fund
of the State of Florida’s conveyance of the 0.22 acres by gift to the City of St. Augustine
provides a greater benefit to the public than its retention in state ownership. BPLA staff
ARC RECOMMENDATION: Approved on consent.
ITEM 18: REQUEST: Consideration to ensure that (1) a 0.18± acre access and utility
easement and (2) a 0.09± acre access and utility easement within the Department of
Environmental Protection, Office of Greenways and Trails (OGT) managed land, East
Central Regional Rail-Trail, are in compliance with the Board of Trustees’ Incompatible
Use Policy.
ARC RECOMMENDATION: Deferral approved on consent.
ITEM 19: REQUEST: Consideration to ensure: (1) that a common understanding of the
intention of the parties with respect to the State Road 40 proposed road widening
project. (2) that a perpetual easement for the proposed widening project (pending final
design and mapping process) are in compliance with the Board of Trustees’ Linear
Facilities Policy.
DISCUSSION: Mr. Farr noted that the item had been revised, based on the discussion from the
previous day.
ARC ACTION: Mr. Breault moved that this item be approved as revised. The motion was
seconded by Dr. Frederick. By unanimous vote, the item was approved.
