Proce<strong>ss</strong> of <strong>Land</strong> <strong>Ali</strong><strong>en</strong>ation<br />

Breeding Farm Violates Specifi c Legal Provisions<br />

This case is cited to highlight ground realities. The establishm<strong>en</strong>t of this particular breeding farm has<br />

not just violated several legal provisions in force in the state, but has also d<strong>en</strong>ied local people their basic<br />

Constitutional rights. The specific list of violations and the context of violation provides an insight into<br />

the pot<strong>en</strong>tial for redre<strong>ss</strong>al.<br />

Violation of the <strong>Land</strong> Acquisition Act<br />

The provisions of <strong>Land</strong> Acquisition Act have be<strong>en</strong> violated totally by the <strong>en</strong>forcem<strong>en</strong>t of the premise that<br />

the land did not b<strong>elo</strong>ng to the villagers but was state property. Since it was state property, no acquisition<br />

notice was deemed nece<strong>ss</strong>ary, nor was c<strong>om</strong>p<strong>en</strong>sation provided to the people. The <strong>Land</strong> Acquisition Act<br />

1894 as applicable to Uttar Pradesh clearly states that those who have a stake in the forest are its trustees<br />

and b<strong>en</strong>eficiaries. Members of the Van Panchayat are the true trustees and b<strong>en</strong>eficiaries of the acquired<br />

area. They also have be<strong>en</strong> d<strong>en</strong>ied foot-tracks and other easem<strong>en</strong>t b<strong>en</strong>efits without any c<strong>om</strong>p<strong>en</strong>sation.<br />

Violation of the Forest Conservation (FC) Act<br />

The farm has violated the FC Act by destroying parts of the forest while laying the road and constructing<br />

buildings, all of which have be<strong>en</strong> specifically recorded by the Van Panchayat. The provisions of c<strong>om</strong>p<strong>en</strong>satory<br />

afforestation have not be<strong>en</strong> applied in the case of the farm. The damage to trees, particularly felling<br />

gre<strong>en</strong> trees is an ongoing activity of the farm, which is not being charged with such off<strong>en</strong>ces.<br />

Violation of the Environm<strong>en</strong>t Protection Act<br />

The activities of the farm violate the provisions of the Environm<strong>en</strong>t Protection Act in several ways. The<br />

foremost among them is the discharge of efflu<strong>en</strong>ts into the stream, polluting water resources, destroying<br />

productive agricultural fields and affecting the health of the people and cattle.<br />

Other Violations<br />

<strong>Land</strong> <strong>en</strong>croachm<strong>en</strong>t, over the above, could attract proceedings on the provisions of land acts.<br />

The carele<strong>ss</strong> disposal of carca<strong>ss</strong>es by the breeding farm could attract wild animals and invite injunctions<br />

under the Wildlife Act.<br />

The farm also gro<strong>ss</strong>ly violates the provisions of the Labour Acts by employing local people on daily<br />

wages despite their having put in several years of service.<br />

The Right to Life is d<strong>en</strong>ied wh<strong>en</strong> the fundam<strong>en</strong>tal source of livelihood is negatively impacted. The<br />

breeding farm also d<strong>en</strong>ies the people the Right to <strong>De</strong>v<strong>elo</strong>pm<strong>en</strong>t, which is also emphasised by several<br />

Supreme Court decisions in rec<strong>en</strong>t years. The people have be<strong>en</strong> also restrained fr<strong>om</strong> performing their<br />

fundam<strong>en</strong>tal duties, particularly the protection of the <strong>en</strong>vironm<strong>en</strong>t, as no notice is tak<strong>en</strong> of their<br />

c<strong>om</strong>plaints regarding the <strong>en</strong>vironm<strong>en</strong>tal impact of the farm.<br />
