is not only the JDA but the whole<br />

state which is <strong>en</strong>gaged in the role of<br />

a middleman and is busy acquiring<br />

farmers’ land cheap and selling it to<br />

big capital investors for a profit.<br />

The result is that the agricultural<br />

land is being acquired and auctioned<br />

for making big malls and hotels.<br />

The laws are being changed to<br />

facilitate this. A rosy picture is being<br />

drawn to prev<strong>en</strong>t the people fr<strong>om</strong><br />

resisting this design. This is leading<br />

to marginalisation of the ag<strong>en</strong>da<br />

of agriculture and livelihood. The<br />

peasantry which leads an honourable<br />

life is thus being forced to take the<br />

course of migrating to metropolis<br />

and is forced to live in slums.<br />

We must seriously think:<br />

• whether the ownership of the<br />

land acquired by the govt.<br />

and giv<strong>en</strong> to a busine<strong>ss</strong>man or<br />

industrialist rests with the govt.<br />

or the industrialist;<br />

• what kind of human, social or<br />

constitutional basis underlies<br />

the giving of land b<strong>elo</strong>nging<br />

to tribals, SCs, minorities and<br />

marginalised farmers to the rich<br />

and to industrialists.<br />

• will the acquired land, after<br />

being freed fr<strong>om</strong> the Ceiling<br />

Proce<strong>ss</strong> of <strong>Land</strong> <strong>Ali</strong><strong>en</strong>ation<br />

Act, remain in the po<strong>ss</strong>e<strong>ss</strong>ion<br />

of industrialists or will it be<br />

distributed among the landle<strong>ss</strong><br />

by bringing it under the Ceiling<br />

Act?<br />

• is land a c<strong>om</strong>modity to be sold<br />

or is it a source of earning a<br />

livelihood?<br />

• these are s<strong>om</strong>e of the main<br />

questions that are the matter<br />

of debate among the people in<br />

Rajasthan.<br />

How the whole system is increasingly<br />

getting anti-people is clear fr<strong>om</strong> the<br />

stand being tak<strong>en</strong> by the <strong>India</strong>n<br />

Judiciary on matters affecting the<br />

people. Take the instance of the<br />

apex court on the question of land<br />

acquisition. The Supreme Court,<br />

in one of important judgm<strong>en</strong>ts,<br />

has said that if the Governm<strong>en</strong>t<br />

acquires land, the notification of this<br />

acquisition cannot be chall<strong>en</strong>ged<br />

in a court. The B<strong>en</strong>ch c<strong>om</strong>prising<br />

Justice Ashok Bhan and Justice<br />

Dalvir Bhandari said that once the<br />

land is acquired, any petition filed<br />

against it shall not be t<strong>en</strong>able in<br />

the Court. Dismi<strong>ss</strong>ing the petition<br />

filed to chall<strong>en</strong>ge the judgm<strong>en</strong>t of<br />

Rajasthan High Court which upheld<br />

the acquisition of land by the Govt.<br />

in Rajasthan, the B<strong>en</strong>ch ruled that in<br />
