inquiry. The c<strong>om</strong>mi<strong>ss</strong>ion is <strong>en</strong>trusted<br />
with analysing the sequ<strong>en</strong>ce of<br />
ev<strong>en</strong>ts and circumstances leading<br />
to the police firing; measures<br />
tak<strong>en</strong> for prev<strong>en</strong>ting or handling<br />
situations; responsibility for acts of<br />
c<strong>om</strong>mi<strong>ss</strong>ion and <strong>om</strong>i<strong>ss</strong>ion on part<br />
of the administration; the role,<br />
conduct, and responsibility of the<br />
organisations, group of individuals<br />
or persons influ<strong>en</strong>cing, precipitating<br />
or escalating the incid<strong>en</strong>ce. The<br />
c<strong>om</strong>mi<strong>ss</strong>ion has received 128<br />
affidavits by concerned parties<br />
including the Tatas, however,<br />
proceedings for cro<strong>ss</strong>-examination<br />
of these affidavits are yet to begin.<br />
A significant fallout of the tragic<br />
incid<strong>en</strong>t is that the state governm<strong>en</strong>t<br />
came out in May, 2006 with an<br />
R&R policy, which has s<strong>om</strong>e very<br />
progre<strong>ss</strong>ive features such as: avoid<br />
displacem<strong>en</strong>t wherever po<strong>ss</strong>ible or<br />
minimise it exploring all po<strong>ss</strong>ible<br />
options; recognise voices of<br />
displaced persons and empathise<br />
with the needs of the indig<strong>en</strong>ous<br />
c<strong>om</strong>munities and vulnerable sections;<br />
<strong>en</strong>sure <strong>en</strong>vironm<strong>en</strong>tal sustainability<br />
through participatory and<br />
transpar<strong>en</strong>t proce<strong>ss</strong> etc. The policy<br />
on the cont<strong>en</strong>tious i<strong>ss</strong>ue of land<br />

acquisition is quite liberal, it states,<br />
“The project propon<strong>en</strong>t may opt for<br />
direct purchase of land on the basis<br />
of negotiated price after i<strong>ss</strong>ue of<br />
notification requiring acquisition of<br />
land under relevant Act. If acquisition<br />
of land through direct purchase fails,<br />
other provisions of the relevant Act<br />
may be invoked. <strong>Land</strong> not utilised<br />
by the project within prescribed<br />
limit and for the required purposes<br />
shall be resumed.” This is a distinct<br />
departure fr<strong>om</strong> the earlier policy.<br />
The policy also c<strong>om</strong>mits that no<br />
physical displacem<strong>en</strong>t shall be made<br />
before c<strong>om</strong>pletion of resettlem<strong>en</strong>t<br />
work. The collector is required to<br />
i<strong>ss</strong>ue a certificate of c<strong>om</strong>pletion of<br />
resettlem<strong>en</strong>t work. The policy also<br />
talks about additional c<strong>om</strong>p<strong>en</strong>sation<br />
to the ext<strong>en</strong>t of 50 per c<strong>en</strong>t of the<br />
normal c<strong>om</strong>p<strong>en</strong>sation in case of<br />
multiple displacem<strong>en</strong>ts.<br />
Regarding b<strong>en</strong>efits to displaced<br />
indig<strong>en</strong>ous families and primitive<br />
tribal groups, the policy pr<strong>om</strong>ises<br />
that their socio-cultural norms will<br />
be respected while dev<strong>elo</strong>ping a<br />
resettlem<strong>en</strong>t plan for them, they<br />
will be giv<strong>en</strong> prefer<strong>en</strong>ce in land<br />
allotm<strong>en</strong>t, will be resettled in a<br />
c<strong>om</strong>pact area close to their natural<br />
habitat and in case of being resettled<br />
