The referee laboratory will be designated by the Owner from a Roster Rotation List maintained by the<br />
Owner for this purpose. The Contract Administrator shall arrange for the delivery <strong>of</strong> samples to the<br />
referee laboratory. The results generated by the referee laboratory shall be used to determine the<br />
payment factors for the acceptance <strong>of</strong> the disputed properties for the disputed lots <strong>of</strong> hot mix. The<br />
results shall be binding on the Contractor and the Owner.<br />
When QC and QA results do not agree, for any referee testing which is carried out without an outlier in<br />
the referee results, the cost <strong>of</strong> referee testing, including sample delivery, shall be borne by the party<br />
whose payment factor is further removed from that generated by the referee laboratory. However, if the<br />
payment factor determined by the referee results is exactly in between that determined by the QC and<br />
QA laboratories, the cost <strong>of</strong> the referee services shall be split between the Owner and the Contractor.<br />
If the QC and QA results agree, the cost <strong>of</strong> referee testing, including sample delivery, shall be borne by<br />
the party requesting the referee testing.<br />
Referee testing shall be charged at the rates outlined elsewhere in the contract.<br />
The QC and QA results shall be deemed to agree if the difference in the compaction payment factor and<br />
the mix properties payment factor calculated using the QA and QC test results are both less than 0.025.<br />
When the QC and QA results agree, the payment factor obtained using the QC results shall apply unless<br />
either party requests referee testing. If this comparison criteria is not met, the QC and QA results shall<br />
be deemed to disagree and Referee testing may be requested by either party as described in this special<br />
provision.<br />
Measurement for Payment<br />
Measurement for payment for above tender items shall be by mass in tonnes according to the<br />
requirements <strong>of</strong> the Contract Documents. Measurement for payment for above tender items used for<br />
temporary ramping specified in the Contract Documents shall be measured in tonnes. Removal <strong>of</strong><br />
temporary ramping specified in the Contract Documents shall not be measured for payment.<br />
Basis <strong>of</strong> Payment<br />
Payment at the Contract price for the above tender item(s) shall include full compensation for all labour,<br />
equipment, and materials required to do the work.<br />
