This is a good example of detailed violation resolution procedures<br />

developed by a midsized land trust. The document also <strong>in</strong>cludes a<br />

section on prevent<strong>in</strong>g violations, address<strong>in</strong>g some of the issues raised<br />

<strong>in</strong> this chapter. As of 2008, the Dutchess Land Conservancy has a staff<br />

of n<strong>in</strong>e, has protected more than 27,000 acres and is accredited.<br />

This document sets forth a succ<strong>in</strong>ct violation policy and violation resolution<br />

procedures. The checklist is a great addition to a land trust’s<br />

procedures and can help ensure that all steps <strong>in</strong> resolv<strong>in</strong>g a violation<br />

have been taken <strong>in</strong> a timely manner and documented. As of 2008,<br />

MALT has a staff of 15 and has protected more than 40,000 acres of<br />

farmland.<br />

Procedure for Enforcement of <strong>Easements</strong>, Mounta<strong>in</strong> <strong>Conservation</strong><br />

Trust of Georgia (page 358)<br />

This small, staffed land trust adopted a procedure for determ<strong>in</strong><strong>in</strong>g the<br />

severity of a violation while consider<strong>in</strong>g mitigat<strong>in</strong>g circumstances.<br />

Although this procedure is not sufficient to represent an entire easement<br />

violation policy, the questions represent a great example of violation<br />

assessment. The Mounta<strong>in</strong> <strong>Conservation</strong> Trust for Georgia has<br />

conserved more than 1,000 acres s<strong>in</strong>ce 1991 and is accredited.<br />

Idaho (page 362)<br />

This document is an example of a medium-size land trust’s policy<br />

that briefly addresses the reasons for enforcement and then sets forth<br />

procedures for respond<strong>in</strong>g to a violation, <strong>in</strong>clud<strong>in</strong>g third-party violations.<br />

As of 2008, the Teton Regional Land Trust has a staff of 11 and<br />

has protected more than 23,234 acres.<br />
