Post-Clos<strong>in</strong>g Easement Stewardship Files<br />

Post-clos<strong>in</strong>g work <strong>in</strong>cludes all the steps necessary for the perpetual<br />

stewardship of the conservation easement, <strong>in</strong>clud<strong>in</strong>g ma<strong>in</strong>tenance of<br />

landowner relations and track<strong>in</strong>g changes <strong>in</strong> landownership, annual<br />

monitor<strong>in</strong>g of the easement, keep<strong>in</strong>g track of approvals and the exercise<br />

of rights reserved under the easement, and address<strong>in</strong>g amendment<br />

and violation issues. At m<strong>in</strong>imum you must be able to track:<br />

• Changes <strong>in</strong> landownership and current contact <strong>in</strong>formation for<br />

all owners<br />

• Changes to the land (both natural and manmade)<br />

• Approvals of exercise of reserved rights, answers to landowners’<br />

<strong>in</strong>quiries and details about any easement <strong>in</strong>terpretations,<br />

amendments or violations<br />

To facilitate track<strong>in</strong>g, you may wish to create two dist<strong>in</strong>ct divisions<br />

with<strong>in</strong> the post-clos<strong>in</strong>g or stewardship folder:<br />

Essential documents generated at clos<strong>in</strong>g<br />

• The recorded conservation easement<br />

• The basel<strong>in</strong>e documentation report<br />

• The easement map or survey<br />

• Any critical correspondence <strong>in</strong>terpret<strong>in</strong>g the conservation easement<br />

or approv<strong>in</strong>g the exercise of a reserved right, resolv<strong>in</strong>g a<br />

violation or other activity<br />

• The appraisal<br />

• IRS Form 8283 (if the easement was a donation or barga<strong>in</strong> sale)<br />

• Landowner names and contact <strong>in</strong>formation<br />

• Landowner contact preferences, if known<br />

Subsequent Stewardship Activities<br />

• Monitor<strong>in</strong>g reports<br />

• Amendments (if applicable)<br />

• Grant or legal agreements (if applicable)<br />

• Violation resolution<br />

• New landowner names and contact <strong>in</strong>formation<br />

• Other documents, <strong>in</strong>clud<strong>in</strong>g management plans or environmental<br />

<strong>in</strong>ventories. Your land trust will have a variety of additional<br />

documents unique to your region, landowners, mission<br />

and resource base for which you will need to determ<strong>in</strong>e if they<br />

are essential to the perpetual stewardship of an easement and,<br />

thus, kept as a part of the post-clos<strong>in</strong>g records.<br />
