PARENTAL RIGHTS<br />

AMEND Rule 9-106 by deleting section (a) and replacing it<br />

with references to certain Code provisions pertaining to<br />

appointment of an attorney; by adding a new section (b) and cross<br />

references after section (b) pertaining to payment of attorneys’<br />

fees; by adding a new section (c) pertaining to an affidavit of<br />

attorney; by deleting the text of existing section (b),<br />

relettering the section (d), and replacing the text of the<br />

section with references to certain Code provisions and new<br />

language pertaining to investigations; by deleting existing<br />

section (c); and by relettering the Rule, as follows:<br />

Rule 9-106. APPOINTMENT <strong>OF</strong> ATTORNEY - ATTORNEY AFFIDAVIT -<br />

INVESTIGATI<strong>ON</strong><br />

(a) Appointment of Attorney<br />

The court shall appoint an attorney for any person<br />

entitled to the appointment pursuant to Code, Family Law Article,<br />

§5-323. The court may appoint an attorney for a minor who is not<br />

otherwise entitled by statute to a court-appointed attorney. If<br />

the petition shows that a person is entitled to a court-appointed<br />

attorney, the court shall appoint an attorney for that person<br />

promptly after the filing of the petition.<br />
