CHAPTER 800 - MISCELLANEOUS<br />

AMEND Rule 16-804 to allow telephone and video conferencing<br />

under certain circumstances, as follows:<br />

Rule 16-804. COMMISSI<strong>ON</strong><br />

(e) Quorum<br />

The presence of a majority of the members of the<br />

Commission constitutes a quorum for the transaction of business,<br />

provided that at least one judge, one lawyer, and one public<br />

member are present. At a hearing on charges held pursuant to<br />

Rule 16-808 (i), a Commission member is present only if the<br />

member is physically present in person. Under all other<br />

circumstances, a member may be present in person or by telephone<br />

or video conferencing. Other than adjournment of a meeting for<br />

lack of a quorum, no action may be taken by the Commission<br />

without the concurrence of a majority of members of the<br />

Commission.<br />

REPORTER’S NOTE<br />

The Honorable Sally D. Adkins, Chair of the Commission on<br />

Judicial Disabilities, requested a modification to Rule 16-804 to<br />

provide for telephone and video conferencing for the Commission.<br />

This will facilitate more participation by members who may have<br />

problems driving to meetings in distant locations or attending<br />

meetings in bad weather.<br />
