REPORTER’S NOTE<br />

In its final report, the Access Rules Implementation<br />

Committee appointed by Chief Judge Bell suggested a need for<br />

further action with respect to financial statements required in<br />

family law actions pursuant to Rule 9-202. The Rules Committee<br />

recommends that Rule 9-203 (d) be amended to provide that a<br />

financial statement becomes open to public inspection when it is<br />

attached to a motion that has been ruled upon by the court or<br />

when the statement has been marked for identification at trial.<br />

Until either of these events occurs, inspection of the financial<br />

statement is governed by Code, State Government Article, §10-617<br />

(a) and (f), which does not permit inspection of public records<br />

containing information about the finances of an individual. The<br />

Committee also recommends adding language to section (d) that<br />

allows a party who wants continued confidentiality of a financial<br />

statement to make a motion to seal it.<br />
