The Board may authorize a further investigation to be<br />

conducted pursuant to Rule 16-806.<br />

(i) Informal Meeting with Judge<br />

The Board may meet informally with the judge for the<br />

purpose of discussing an appropriate disposition.<br />

(j) Board’s Report to Commission<br />

(1) Contents<br />

Upon receiving Investigative Counsel’s final report and<br />

recommendation concerning a further investigation or a<br />

preliminary investigation if no further investigation was<br />

conducted and subject to subsection (j)(2) of this Rule, the<br />

Board shall submit to the Commission a report that includes<br />

one of the following recommendations: (A) dismissal of any<br />

complaint and termination of the investigation with or without a<br />

warning; (B) entering into a private reprimand or deferred<br />

discipline agreement; or (C) upon a determination of probable<br />

cause, the filing of charges, unless the Board determines that<br />

there is a basis for private disposition under the standards of<br />

Rule 16-807. The Board may not recommend a dismissal with a<br />

warning, a private reprimand, or a deferred discipline agreement<br />

unless the respondent judge has consented to this remedy.<br />

(2) Limitation on Contents of Report<br />

The information transmitted by the Board to the<br />

Commission shall be limited to a proffer of evidence that the<br />

Board has determined would be likely to be admitted at a plenary<br />

hearing. The Chair of the Board may consult with the Chair of<br />
