challenging the standing of the person to file the notice or the<br />

timeliness of the filing of notice of objection.<br />

(e) Hearing<br />

If the petitioner any party files a response, the court<br />

shall hold a hearing promptly on the issues raised in the<br />

response.<br />

(f) Access to Records<br />

If the court determines that the person filing the notice<br />

of objection has standing to do so and that the notice is timely<br />

filed, it shall enter an order permitting the person to inspect<br />

the papers filed in the proceeding subject to reasonable<br />

conditions imposed in the order.<br />

REPORTER’S NOTE<br />

Rule 9-107 contains a change in subsection (b)(4) conforming<br />

the procedure for publication to that required by the new statute<br />

and adding in a time limit similar to the one provided for in<br />

Rule 2-321 to conform the procedure to similar procedures in<br />

other Rules. Sections (c), (d), and (e) have been modified to<br />

broaden the scope of the Rule by replacing the word “petitioner”<br />

with the word “party” or “parties.”<br />
