the Commission in making the determination as to what information<br />

is transmitted to the Commission.<br />

(3) Time for Submission of Report<br />

Unless the time is extended by the Chair of the<br />

Commission, the Board shall transmit the report to the Commission<br />

within 45 days after the date the Board receives Investigative<br />

Counsel’s report and recommendation. Upon written request by the<br />

Chair of the Board, the Chair of the Commission may grant one 30-<br />

day extension of time for transmission of the report. If the<br />

Board does not issue its report within the time allowed, the<br />

Chair of the Commission and Investigative Counsel shall conform<br />

the report and recommendation of Investigative Counsel to the<br />

requirements of subsection (j)(2) of this Rule and refer the<br />

matter to the Commission, which may proceed, using the report and<br />

recommendation of Investigative Counsel.<br />

(4) Copy to Investigative Counsel and Judge<br />

Upon receiving the report and recommendation, the<br />

Commission promptly shall transmit a copy of it to Investigative<br />

Counsel and to the judge.<br />

(k) Filing of Objections<br />

Investigative Counsel and the judge shall file with the<br />

Commission any objections to the report and recommendation within<br />

15 days of the date the Commission transmitted the report and<br />

recommendation unless Investigative Counsel, the judge, and the<br />

Chair of the Commission agree to an extension of the time for<br />

filing an objection.<br />
