PARENTAL RIGHTS<br />

AMEND Rule 9-109 by adding references to certain Code<br />

provisions to subsection (a)(1); by making optional the holding<br />

of a hearing in a consensual public or private agency<br />

guardianship; by adding a cross reference after subsection<br />

(a)(2); by deleting section (b); by adding a new subsection<br />

(b)(2) referring to certain Code provisions; by changing the<br />

words “in order” to the word “filed” in subsection (b)(3)(D); by<br />

revising subsection (b)(3)(F) to apply only to a nonconsensual<br />

independent adoption, including a reference to certain Code<br />

provisions; and by adding a cross reference after subsection<br />

(b)(3)(I), as follows:<br />

Rule 9-109. HEARING <strong>ON</strong> MERITS<br />

(a) Requirement<br />

(1) Generally<br />

The court shall hold a hearing and make findings on the<br />

record on the merits in of a contested guardianship action and in<br />

every or adoption action prior to entering a judgment of adoption<br />

or guardianship. petition as provided by Code, Family Law<br />

Article:<br />

(A) §5-318 in a nonconsensual Public Agency Guardianship;<br />
