court on any motion shall be on the record and shall be conducted<br />

out of the presence of all persons except those whose presence is<br />

necessary.<br />

(c) Completion<br />

Investigative Counsel shall complete a further<br />

investigation within 60 days after it is authorized by the Board<br />

or Commission. Upon application by Investigative Counsel made<br />

within the 60-day period and served by first class mail upon the<br />

judge or counsel of record, the Commission, for good cause, may<br />

extend the time for completing the further investigation for a<br />

specified reasonable time. The Commission may dismiss the<br />

complaint and terminate the investigation for failure to comply<br />

with the time requirements of this section.<br />

(d) Recommendation by Investigative Counsel<br />

Within the time for completing a further investigation,<br />

Investigative Counsel shall report the results of the<br />

investigation to the Board or the Commission in the form that the<br />

Commission requires. The report shall include one of the<br />

following recommendations: (1) dismissal of any complaint and<br />

termination of the investigation, with or without a warning, (2)<br />

the offer of entering into a private reprimand or a deferred<br />

discipline agreement, or (3) the filing of charges.<br />
