Investigative Counsel shall afford the judge a reasonable<br />

opportunity to present, in person or in writing, such information<br />

as the judge chooses.<br />

(5) (6) Investigative Counsel shall complete a preliminary<br />

investigation within 90 days after the investigation is<br />

commenced. Upon application by Investigative Counsel within the<br />

90-day period and for good cause, the Commission Board shall<br />

extend the time for completing the preliminary investigation for<br />

an additional 30-day period. For failure to comply with the time<br />

requirements of this section, the Commission may dismiss any<br />

complaint and terminate the investigation.<br />

(f) Recommendation by Investigative Counsel<br />

Within the time for completing Upon completion of a<br />

preliminary investigation, Investigative Counsel shall report to<br />

the Board the results of the investigation in the form that the<br />

Commission requires. The report shall include one of the<br />

following recommendations: (1) dismissal of any complaint and<br />

termination of the investigation, with or without a warning, (2)<br />

the offer of entering into a private reprimand or a deferred<br />

discipline agreement, (3) authorization of a further<br />

investigation, or (4) the filing of charges.<br />

(g) Monitoring and Review by Board<br />

The Board shall monitor investigations by, and review the<br />

reports and recommendations of, Investigative Counsel.<br />
