1.5.4 Disputes concerning AT&T’s claim of space exhaust, or near exhaust, or <strong>Southern</strong> <strong>Light</strong>’s refusal<br />

to return requested Collocation Space should be resolved by AT&T and <strong>Southern</strong> <strong>Light</strong> pursuant to<br />

the dispute resolution language contained in the General Terms and Conditions.<br />

1.6 Use of Space. <strong>Southern</strong> <strong>Light</strong> may only place in the Collocation Space equipment necessary for<br />

interconnection with AT&T’s services/facilities or for accessing AT&T’s unbundled network<br />

elements for the provision of Telecommunications Services, as specifically set forth in this<br />

Agreement. The Collocation Space assigned to <strong>Southern</strong> <strong>Light</strong> may not be used for any purposes<br />

other than as specifically described herein, including, but not limited to office space or a place of<br />

reporting for <strong>Southern</strong> <strong>Light</strong>’s employees or certified suppliers.<br />

1.7 Rates and Charges. <strong>Southern</strong> <strong>Light</strong> agrees to pay the rates and charges identified in Exhibit B.<br />

1.8 Due Dates. If any due date contained in this Attachment falls on a weekend or a national holiday,<br />

then the due date will be the next business day thereafter. For intervals of ten (10) days or less,<br />

national holidays will be excluded. For purposes of this Attachment, national holidays include the<br />

following: New Year’s Day, Martin Luther King, Jr. Day, President’s Day (Washington’s Birthday),<br />

Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day<br />

and Christmas Day.<br />

1.9 Compliance. Subject to Section 24 of the General Terms and Conditions of this Agreement, the<br />

Parties agree to comply with all applicable federal, state, county, local and administrative laws,<br />

rules, ordinances, regulations and codes in the performance of their obligations hereunder.<br />

2 Optional Reports<br />

2.1 Space Availability Report. Upon request from <strong>Southern</strong> <strong>Light</strong> and at <strong>Southern</strong> <strong>Light</strong>’s expense,<br />

AT&T will provide a written report (Space Availability Report) describing in detail the space that is<br />

currently available for collocation at a particular AT&T Premises. This report will include the<br />

amount of Collocation Space available at the AT&T Premises requested, the number of collocators<br />

present at the AT&T Premises, any modifications in the use of the space since the last report on<br />

the AT&T Premises requested and the measures AT&T is taking to make additional space<br />

available for collocation arrangements. A Space Availability Report does not reserve space at the<br />

AT&T Premises for which the Space Availability Report was requested by <strong>Southern</strong> <strong>Light</strong>.<br />

2.1.1 The request from <strong>Southern</strong> <strong>Light</strong> for a Space Availability Report must be in writing and include the<br />

AT&T Premises street address, as identified in the LERG, and the CLLI code for the AT&T<br />

Premises requested. CLLI code information is located in the NECA Tariff FCC No. 4.<br />

2.1.2 AT&T will respond to a request for a Space Availability Report for a particular AT&T Premises<br />

within ten (10) days of the receipt of such request.<br />

2.1.3 AT&T will use commercially reasonable efforts to respond in ten (10) days to a Space Availability<br />

Report request when the request includes from two (2) to five (5) AT&T Premises within the same<br />

state. The response time for Space Availability Report requests of more than five (5) AT&T<br />

Premises, whether the request is for the same state or for two (2) or more states within the AT&T<br />

Southeast Region 9-State, shall be negotiated between the Parties.<br />

2.2 Remote Terminal Information. Upon request, AT&T will provide <strong>Southern</strong> <strong>Light</strong> with the following<br />

information concerning AT&T’s remote terminals: (i) the address of the remote terminal; (ii) the<br />

CLLI code of the remote terminal; (iii) the carrier serving area of the remote terminal; (iv) the<br />

designation of which remote terminals subtend a particular central office; and (v) the number and<br />

address of customers that are served by a particular remote terminal.<br />
