Kapittel 2. Bruksrett i bygdeallmenn<strong>in</strong>g.<br />

§ 2-1. (vilkår for bruksrett)<br />

Bruksrett i bygdeallmenn<strong>in</strong>g ligger til<br />

jordbrukseiendommer <strong>in</strong>nen det bygdelag<br />

som fra gammel tid har utøvd bruksrett i<br />

allmenn<strong>in</strong>gen.<br />

Med jordbrukseiendommer forstås<br />

eiendommer som etter dyrket areal,<br />

beliggenhet, bebyggelse og bruk har karakter<br />

av jordbruk. For bureis<strong>in</strong>gsbruk stilles ikke<br />

krav om eksisterende bebyggelse.<br />

§ 2-2. (bruksrettens <strong>in</strong>nhold)<br />

Eier av eiendom med tilliggende bruksrett<br />

kan bare utøve retten til dekn<strong>in</strong>g av<br />

eiendommens behov ved jordbruksmessig<br />

drift. Retten skal kunne utøves på en måte<br />

som til enhver tid er i samsvar med rasjonell<br />

bruk, og som er naturlig etter tiden og<br />

forholdene.<br />

Er allmenn<strong>in</strong>gens avkastn<strong>in</strong>g utilstrekkelig til<br />

dekn<strong>in</strong>g av det samlede bruksbehov, skal det<br />

foretas en forholdsmessig avkort<strong>in</strong>g.<br />

§ 2-3. (salg, fraskrivelse, avløsn<strong>in</strong>g)<br />

Bruksrett i bygdeallmenn<strong>in</strong>g kan ikke ved<br />

salg eller på annen måte skilles fra den<br />

jordbrukseiendommen som retten tilligger.<br />

Bruksretten kan heller ikke fraskrives, leies<br />

bort uten i forb<strong>in</strong>delse med forpaktn<strong>in</strong>g av<br />

den berettigede eiendom, eller kreves avløst<br />

mot vederlag.<br />

§ 2-4. (forpaktn<strong>in</strong>g)<br />

Ved forpaktn<strong>in</strong>g av eiendom med tilliggende<br />

bruksrett, skal det fremgå av en<br />

forpaktn<strong>in</strong>gsavtale om forpakteren helt eller<br />

delvis skal utøve bruksrett i allmenn<strong>in</strong>gen.<br />

Bruksretten kan ikke utøves av forpakteren<br />

hvis ikke forpaktn<strong>in</strong>gsavtalen har m<strong>in</strong>st to års<br />

varighet.<br />

Chapter 2 Rights of common <strong>in</strong> bygd<br />

commons<br />

Section 2-1 (terms for rights of common)<br />

Rights of common <strong>in</strong> bygd commons belong<br />

to agricultural hold<strong>in</strong>gs with<strong>in</strong> the<br />

communitiy which from ancient times have<br />

exercised the rights of common <strong>in</strong> the<br />

commons.<br />

With agricultural hold<strong>in</strong>g is meant hold<strong>in</strong>gs<br />

that accord<strong>in</strong>g to cultivated area, location,<br />

build<strong>in</strong>gs and use have the character of<br />

agriculture. For new farms [on land <strong>in</strong> the<br />

outfields], no requirement is set concern<strong>in</strong>g<br />

exist<strong>in</strong>g build<strong>in</strong>gs.<br />

Section 2-2 (content of rights of common)<br />

The owner of the hold<strong>in</strong>g with rights of<br />

common appendant may only exercise the<br />

right to the extent necessary to cover needs of<br />

the hold<strong>in</strong>g for agriculture-related operations.<br />

The right should be exercised <strong>in</strong> a way that, at<br />

any time, is <strong>in</strong> accordance with rational use,<br />

and which is natural accord<strong>in</strong>g to the time<br />

and the conditions.<br />

If the commons' yields are <strong>in</strong>sufficient to<br />

cover the overall needs of the farm, there will<br />

be a proportional reduction.<br />

Section 2-3 (sale, waiver, disposal)<br />

Rights of common <strong>in</strong> bygd commons cannot<br />

by sale or otherwise be separated from the<br />

agricultural hold<strong>in</strong>g <strong>in</strong> which the right is<br />

vested. The rights of common can<br />

furthermore not be waived, rented out except<br />

<strong>in</strong> connection with the tenancy of the eligible<br />

hold<strong>in</strong>g, or demanded ext<strong>in</strong>guished for<br />

compensation.<br />

Section 2-4 (tenancy)<br />

With the tenancy of a hold<strong>in</strong>g with rights of<br />

common appendant, it shall be stated <strong>in</strong> a<br />

tenancy agreement whether the leaseholder <strong>in</strong><br />

whole or <strong>in</strong> part shall exercise user rights <strong>in</strong><br />

the commons. Rights of common cannot be<br />

exercised by the leaseholder unless the<br />

tenancy agreement has a duration of at least<br />
