§ 6-4. (seter)<br />
Eiendom med tilliggende bruksrett i<br />
bygdeallmenn<strong>in</strong>g, jfr. § 2-1, har rett til å få<br />
utvist seter i allmenn<strong>in</strong>gen - enten alene eller<br />
sammen med andre (fellesseter) – når det<br />
godtgjøres at seter er nødvendig for driften av<br />
eiendommen.<br />
Utvisn<strong>in</strong>g etter første ledd foretas av<br />
allmenn<strong>in</strong>gsstyret. Det er et vilkår at<br />
utvisn<strong>in</strong>g kan skje uten vesentlig skade for<br />
skogen eller for de øvrige bruksberettigede,<br />
og at utvisn<strong>in</strong>g heller ikke vil være til h<strong>in</strong>der<br />
for en hensiktsmessig <strong>in</strong>ndel<strong>in</strong>g og utnyttelse<br />
av beitet.<br />
§ 6-5. (særbestemmelser om fellesseter)<br />
Når det utvises seter til felles bruk for flere,<br />
jfr. § 6-4 første ledd, skal adgangen til å være<br />
med så vidt mulig stå åpen for alle<br />
bruksberettigede.<br />
For eiendommer som allerede har seter i<br />
allmenn<strong>in</strong>gen, kan deltakelse i anlegg av<br />
fellesseter gjøres bet<strong>in</strong>get av at den seter<br />
eiendommen har oppgis.<br />
Allmenn<strong>in</strong>gsstyret kan også gi eiendommer<br />
uten tilliggende bruksrett i allmenn<strong>in</strong>gen<br />
anledn<strong>in</strong>g til å være med på anlegg av<br />
fellesseter, på vilkår som i tilfelle fastsettes<br />
ved avtale.<br />
§ 6-6. (bortfall av utvist rett)<br />
Utvist rett til seter faller bort hvis det ikke<br />
<strong>in</strong>nen fem år etter utvisn<strong>in</strong>gen er opptatt<br />
seterdrift overensstemmende med<br />
opplysn<strong>in</strong>ger gitt i søknaden og eventuelle<br />
vilkår som er satt for utvisn<strong>in</strong>gen.<br />
Section 6-4 (‘seter’ – mounta<strong>in</strong> pastures and<br />
houses)<br />
Hold<strong>in</strong>gs with adjacent rights of common <strong>in</strong><br />
the bygd commons, cf. Section 2-1, has the<br />
right to receive allocation of mounta<strong>in</strong><br />
pasture, <strong>in</strong>clud<strong>in</strong>g the right to put up houses,<br />
<strong>in</strong> the commons - either alone or together<br />
with others (jo<strong>in</strong>t mounta<strong>in</strong> pasture) - when it<br />
is demonstrated that the pastures are<br />
necessary for the operation of the hold<strong>in</strong>g.<br />
Allocations accord<strong>in</strong>g to the first paragraph<br />
are made by the commons board. It is a<br />
condition that the allocation may occur<br />
without significant harm to the forest or for<br />
others with rights of common, and that the<br />
allocation does not preclude a suitable<br />
division and utilization of the pasture.<br />
Section 6-5 (special provisions for jo<strong>in</strong>t<br />
mounta<strong>in</strong> pasture and hous<strong>in</strong>g)<br />
When mounta<strong>in</strong> pastures and hous<strong>in</strong>g are<br />
allocated for jo<strong>in</strong>t use for several, cf. Section<br />
6-4 first paragraph, the access to participate<br />
as far as possible is open for all who have<br />
rights of common.<br />
For hold<strong>in</strong>gs that already have pastures and<br />
houses <strong>in</strong> the commons, the participation <strong>in</strong><br />
the establishment of jo<strong>in</strong>t mounta<strong>in</strong> pasture<br />
and houses can be made conditional on the<br />
fact that the mounta<strong>in</strong> pasture and houses that<br />
the hold<strong>in</strong>g already holds is forfeited.<br />
The commons board may also give hold<strong>in</strong>gs<br />
without rights of common appendant <strong>in</strong> the<br />
commons the opportunity to participate <strong>in</strong> the<br />
establishment of jo<strong>in</strong>t pasture and hous<strong>in</strong>g<br />
[fellesseter], under conditions which <strong>in</strong> the<br />
case are determ<strong>in</strong>ed by agreement.<br />
Section 6-6 (loss of allocated right)<br />
Allocated right to mounta<strong>in</strong> pasture with<br />
hous<strong>in</strong>g lapses if with<strong>in</strong> five years after the<br />
grant if pasture operations (e.g. farm<strong>in</strong>g) have<br />
not commenced <strong>in</strong> accordance with<br />
<strong>in</strong>formation <strong>in</strong> the application and any<br />
conditions which are set for the allocation.<br />
