5.7.1 Permitted Uses<br />
1) Agriculture.<br />
2) Public parks including golf courses and outdoor recreation facilities.<br />
3) Hunting, fishing and trapping.<br />
4) Raising of game animals, waterfowl and fish.<br />
5) Harvesting of any natural crops.<br />
6) Communication and power transmission lines and other public utility lines<br />
7) Accessory buildings or structures to any permitted uses<br />
5.7.2 Conditional Uses<br />
1) Refreshment stands accessory to a public park.<br />
2) Restaurants that are accessory to a public park.<br />
3) Sports facilities, fields, and arenas.<br />
4) Retail accessory to a park.<br />
5.8 Floodplain Overlay District: Purpose<br />
The purpose of this district is to minimize private and public losses due to flood conditions.<br />
5.8.1 Land to Which Ordinance Applies<br />
Applicability – The floodplain overlay district consists of the lands which have been<br />
or may be covered by flood waters as delineated on maps of <strong>Stark</strong> <strong>County</strong> prepared<br />
by the Federal Emergency Management Agency (FEMA) for administration of the<br />
National Flood Insurance Program or other maps and information provided by the<br />
State of <strong>North</strong> <strong>Dakota</strong>. The areas delineated as floodplain shall be an overlay for all<br />
zoning districts.<br />
5.8.2 Warning and Disclaimer of Liability<br />
The degree of flood protection required by this Ordinance is considered reasonable<br />
for regulatory purposes and is based on scientific and engineering considerations.<br />
This Ordinance does not imply that land outside the areas of special flood hazards or<br />
uses permitted within such areas will be free from flooding or flood damages. This<br />
Ordinance shall not create liability on the part of <strong>Stark</strong> <strong>County</strong>, any officer or<br />
employee thereof, or the Federal Insurance Administration, for any flood damages<br />
that result from reliance on this Ordinance or any administrative decision lawfully<br />
made there under.<br />
