3) The amendment receiving a proper protest shall not be approved except by a<br />

supermajority (four-fifths) vote of the county commission.<br />

4) Any decision of the zoning administrator may be appealed to the Board of <strong>County</strong><br />

Commissioners within 30 days from such decision. The Board of <strong>County</strong><br />

Commissioners may reverse, affirm, amend, adjust or change any decision of the<br />

zoning administrator. Notice of hearing on the appeal shall be published at least<br />

twice not less than two (2) weeks prior to the hearing.<br />

5) Any decision of the Board of <strong>County</strong> Commissioners may be appealed to the district<br />

court as provided in chapter 40-47-08, NDCC.<br />

8.9 Permits and Fees<br />

1) It shall be unlawful for any person to commence construction, alteration, or<br />

conversion of any building or structure without first obtaining a building<br />

application from the <strong>County</strong> Zoning Administrator or its designee.<br />

2) This section does not apply to those buildings or structures directly used in<br />

connection with farming operations and constructed by farmers as defined<br />

herein.<br />

3) A building application issued pursuant to these provisions shall expire one<br />

year from date of issuance.<br />

The <strong>County</strong> Zoning Administrator shall charge and collect a fee as follows;<br />

resolution of fees and schedules established by the Commission. The applicant for a<br />

conditional use permit, variance, or building application, shall be liable for and pay<br />

to the <strong>County</strong> Zoning Administrator sufficient sums of money to pay for and cover<br />

costs incurred by the <strong>County</strong> for the processing of such application, including, but<br />

not limited to: publication costs, attorney’s fees, mileage, copying expense, etc. No<br />

permit shall be issued until such costs have been paid by the applicant, unless the<br />

<strong>County</strong> Zoning Administrator has otherwise provided for good cause shown.<br />

8.10 Violations and Penalties<br />

If any building or structure is erected, constructed, reconstructed, altered, repaired,<br />

converted or maintained, or if any building, structure, or land is used in violation of this<br />

Ordinance, the proper county authorities or any affected citizen or property owner, in<br />

addition to other remedies, may institute any appropriate action or proceeding:<br />
