6.27.8 Renewal of Conditional Use Permit<br />

Any Temporary Crew Housing Permit granted in accordance with this section<br />

shall expire two years from the date of issuance. The permit may be extended by<br />

the Planning and Zoning Board upon written application of the owner of the<br />

property or authorized representative provided that the extension is for the same<br />

use as specified in the original permit and that the applicant is in compliance with<br />

the terms and conditions specified in the original permit.<br />

6.28 Utilities – Underground and Overhead<br />

The setback for utilities, whether underground or overhead, for all section lines and all roads<br />

within the county shall be a minimum of seventy-five (75) feet or the existing right-of-way<br />

easement, whichever is greater.<br />

6.29 Enchanted Highway Setbacks<br />

Notwithstanding anything to the contrary herein, no structure allowed in a Commercial or<br />

Industrial District shall be located within one (1) mile of the center line of the Enchanted<br />

Highway and no structure of more than thirty (30) feet in height shall be located within this<br />

restricted area.<br />

6.30 Temporary Use Permit<br />

A temporary use permit may be granted by the <strong>County</strong> Zoning Administrator following a<br />

ruling by the Planning and Zoning Commission on the application submitted. Temporary<br />

use permits shall apply to the structures and uses identified as appropriate under each<br />

district, and any other activities or uses considered by the Planning and Zoning Commission<br />

to warrant limitations on the length of time the land can be occupied by said use or activity.<br />

Unless otherwise provided, all temporary use permits are reviewable on an annual basis.<br />

The application for a temporary use permit shall contain the information required for a<br />

conditional use permit and under the district’s Ordinances plus a justification for the permit<br />

period requested by the applicant.<br />

A public hearing on the temporary use permit request shall be held following proper notice<br />

pursuant to Section 11-33-08 NDCC. The notice shall include a description of the action and<br />

location in sufficient detail so that concerned parties may determine the action’s impacts. A<br />

temporary use permit fee shall be paid in an amount to be determined by the <strong>County</strong><br />

Commission.<br />

6.31 Farm Animals<br />

The number of farm animals allowed on properties five acres or greater in size shall be two<br />

(2) per five acres.<br />
