3) The drainage facilities shall be located in street right-of-way or in drainage<br />
easements.<br />
4) All developers should submit a management plan for storm water.<br />
5) The grading and drainage system shall be approved by the Planning and Zoning<br />
Commission.<br />
6) Grading established in any subdivision shall not be changed without approval of the<br />
Planning and Zoning Commission.<br />
7.17 Drainage Way Easement<br />
Where a subdivision is traversed by a water course or drainage way, an adequate grading of<br />
such easement shall be set by the Planning and Zoning Commission to accommodate the<br />
anticipated discharge from the property being subdivided and also the anticipated run-off<br />
from the adjoining properties.<br />
7.18 Tree Planting<br />
The planting of trees of an appropriate species and at appropriate locations may be required<br />
by the Planning and Zoning Commission. Trees must be placed at a minimum setback of<br />
one hundred (100) feet from county road centerlines.<br />
7.19 Street Lights<br />
Street lights and their location shall be in accordance with the minimum standards to be<br />
established by the Planning and Zoning Commission.<br />
7.20 Required Improvements<br />
Before installation of improvements in any subdivision, the Planning and Zoning<br />
Commission shall make a determination for improvements required, based on a schedule of<br />
improvements including the standards and class of construction.<br />
1) Completion Assurance<br />
To cover the cost of improvements, as determined by the Planning and Zoning<br />
Commission, the subdivider may be required to post a bond or submit a letter of<br />
credit from an acceptable financial institution in an amount sufficient to construct<br />
such improvements and submit a plan of financial responsibility of unpaid<br />
improvement assessments.<br />
2) Survey Monuments<br />
The subdivider shall install survey monuments in all lot and block corners in the<br />
subdivision in accordance with the requirements of the State of <strong>North</strong> <strong>Dakota</strong>.<br />
