Court Quashes Charge<br />
On Foto-Nite Legality<br />
OTTAWA—A highly important precedent<br />
was established in the country court here in<br />
connection with the legality of the Foto-Nite<br />
stunt, when a charge against the Linden, an<br />
independent theatre, was quashed by Judge<br />
J. P. Madden after the hearing of argument<br />
by opposing counsel.<br />
The theatre, the proprietor of which is<br />
Casey Swedlove, was charged early this<br />
year with the infraction of the Criminal<br />
Code of Canada by conducting a lottery, the<br />
charge being laid by the Ottawa police department.<br />

theatre and not an individual had been<br />
