GENERAL CONDITIONS OF CONTRACT<br />

1. AUTHORITY OF ENGINEER - IN - CHARGE.<br />

Save in so far as it is legally or physically impossible, the contractor shall execute complete and<br />

maintain the works in strict accordance with the contract under the directions and to the entire<br />

satisfaction <strong>of</strong> the Engineer - in - charge and shall comply with and adhere strictly to the<br />

Engineer - in - charge instructions and directions on any matter (Whether mentioned in the<br />

contract or not) pertaining to this work.<br />

The Engineer - in - charge shall decide all questions which may arise as to quality and<br />

acceptability <strong>of</strong> materials furnished and work executed, manner <strong>of</strong> executions, rate <strong>of</strong> progress<br />

<strong>of</strong> work, interpretations <strong>of</strong> the plans and specifications and acceptability <strong>of</strong> fulfilment <strong>of</strong> the<br />

contract on the part <strong>of</strong> contractor. He shall determine the amount and quality <strong>of</strong> work performed<br />

and materials furnished and his decision and measurements shall be final. In all such matters<br />

and in any technical questions which may arise touching the contract, his decision shall be<br />

binding on the contractor. The engineer in charge shall have power to enforce such decisions<br />

and orders if the contractor fails to carry out them promptly. If the contractor fails to execute the<br />

work order by the engineer in charge, the engineer in charge may give notice to the contractor<br />

specifying a reasonable period therein and on the expiry <strong>of</strong> that period proceed to execute such<br />

work as may be deemed necessary and recover the cost there<strong>of</strong> from the contractor.<br />

1.1 AUTHORITY OF ENGINEER-IN-CHARGE REPRESENTATIVE.<br />

The duties <strong>of</strong> the representative <strong>of</strong> the engineer in charge are to watch and supervise the work<br />

and to test and examine any material to be used or workmanship employed in connection with<br />

the works.<br />

1.2 The engineer in charge may from time to time in writing delegate to his representative<br />

any <strong>of</strong> the powers and authorities vested in the Engineer in charge and shall furnish to the<br />

contractor a copy <strong>of</strong> all such delegations <strong>of</strong> powers and authorities. Any written instructions <strong>of</strong><br />

the approval given by the representative <strong>of</strong> the engineer in charge to the contractor within the<br />

terms <strong>of</strong> such delegations (but not otherwise) shall bind the contractor and department as<br />

though it had been given by the Engineer in charge provided always as follows.<br />

(a) Failure <strong>of</strong> the representative <strong>of</strong> the engineer in charge to disapprove any work or<br />

materials shall not prejudice the power <strong>of</strong> the engineer in charge. Thereafter to<br />

disapprove such work or materials and to order pulling down, removal or breaking up<br />

there<strong>of</strong>.<br />

(b) If the contractor is dissatisfied with any decision <strong>of</strong> the representative <strong>of</strong> the engineer in<br />

charge he shall be entitled to refer the matter to the engineer in charge who shall<br />

thereupon confirm reverse or vary such decisions.<br />

2. OTHER CONDITIONS FOR SUBMISSION OF TENDER :<br />

2.1 The contractor shall be deemed to have carefully examined the work and site conditions<br />

including labours, the general and he special conditions, the specification schedule and drawing<br />

and shall be deemed to have visited the site <strong>of</strong> the work and to have fully informed himself<br />

regarding the local conditions and carried out his own investigations to arrive at the rates<br />

quoted in the tender. In this regards he will be given necessary information to the best <strong>of</strong> the<br />
