have fully informed himself regarding the local conditions and carried out his own<br />

investigations to arrive at the rates quoted in the tender. In this regards he will be given<br />

necessary information to the best <strong>of</strong> the knowledge <strong>of</strong> Department but without any<br />

guarantee about it. If he shall have any doubt as to the meaning <strong>of</strong> any portion <strong>of</strong> these<br />

general conditions, or the special conditions to the scope <strong>of</strong> working <strong>of</strong> the specification<br />

and drawings, or any other matter concerning the contract, he shall in good time before<br />

submitting his tender set forth the particulars there<strong>of</strong> and submit them to the Engineer in<br />

writing in order that such doubt may be clarified authoritatively before tendering. Once a<br />

tender is submitted the matter will be decided in accordance to the tender conditions in<br />

absence <strong>of</strong> such authentic clarification.<br />

38. ERRORS,,OMISSION&DISCREPANCIES :<br />

a) In case <strong>of</strong> errors, omissions and / or disagreement between written and scaled<br />

dimensions in the drawing or between the drawing and specifications etc., the following<br />

order <strong>of</strong> preference shall apply.<br />

(i) Between actual scaled and written dimensions or description on a drawing the<br />

latter shall be adopted.<br />

(ii) Between the written description or dimensions in the drawing and the<br />

corresponding one in the specifications, the latter shall apply.<br />

(iii) Between the quantities shown in the schedule <strong>of</strong> quantities and those arrived at<br />

from the drawing the latter shall preferred<br />

b) In all cases <strong>of</strong> omissions and/or doubts or discrepancies in the dimensions or <strong>of</strong> any<br />

item or specification a reference shall be made to the engineer, whose elucidation,<br />

elaboration or decision shall be considered as authentic. The contractor shall be held<br />

responsible for any errors that may occur in the work through lack <strong>of</strong> such reference and<br />

precautions.<br />

c) The contractor should not sublet any part <strong>of</strong> work without written permission <strong>of</strong> the<br />

Engineer in charge.<br />

39. SAMPLES AND TESTING OF MATERIALS :<br />

(i) All materials to be used on work, such as cement, steel, stones, bricks, aggregates,<br />

asphalt, wood, tiles, etc. shall be got approved in advance from the Engineer-in-charge<br />

and shall pass the tests and analysis required by him.<br />

(ii) The contractor shall at his risk and cost make all arrangement and / or shall provide for<br />

all such facilities as the Engineer in charge may require for collecting, preparing and<br />

forwarding required number <strong>of</strong> samples for tests or for analysis to the nearest approved<br />

laboratory and bear all charges and cost <strong>of</strong> testing. Such samples shall also be<br />

deposited with the Engineer-in-charge till sent for testing. Out <strong>of</strong> total number <strong>of</strong> tests as<br />

per frequency requirement 20 % <strong>of</strong> these tests shall be carried out in PMJSY<br />

Department Laboratory.<br />

(iii) The contractor shall if and when required submit at his cost the samples <strong>of</strong> materials to<br />

be tested or analysed and if so directed shall not make use or incorporate in the work<br />

any material represented by the samples until the required tests or analysis have been<br />

made after the test <strong>of</strong> the materials finally accepted by the Engineer-in-charge.<br />

(iv) Testing <strong>of</strong> Material :<br />

(1) Frequency <strong>of</strong> testing <strong>of</strong> the construction material and the percentage <strong>of</strong> the testing from<br />

the Government laboratory shall be as under:<br />

(a) Where the field laboratory certified by the concerned Executive Engineer is established<br />

at the work site 70% test as per total frequency required shall be carried out in the said field<br />

laboratory and 30% tests shall be carried out at the Vigilance and Quality control laboratory<br />

<strong>of</strong> P.W.D Maharashtra for the materials mentioned in Annexure X attached herewith on<br />

(page No 79 to 82 ) for the material not covered in the annexure X 50% tests shall be<br />
