2.2 It is presumed that the contractor has carefully gone through the works specifications.<br />

P.W.D. Hand Book and the Schedule <strong>of</strong> rates <strong>of</strong> the division and studied the site conditions<br />

before arriving at the rates quoted by him.<br />

3. TREASURE TROVE :<br />

In the event <strong>of</strong> discovery by the contractor or his employees during the progress <strong>of</strong> the<br />

works <strong>of</strong> the any treasure, fossils, minerals or any other article <strong>of</strong> value or interest, the<br />

contractor shall give immediate intimation there<strong>of</strong> to the Engineer. And forth with mark<br />

over to the Engineer his representative such treasure or things, which shall be the<br />

property <strong>of</strong> Government.<br />

3 –A LAYOUT OF WORK<br />

Layout <strong>of</strong> the work will be done by the contractor in consultation with the Executive<br />

Engineer, <strong>of</strong> the department or his representative. Some permanent marks should<br />

however be established to indicate the demarcation <strong>of</strong> the structures or any component<br />

there<strong>of</strong> made to this permanent marks in measurement books and drawing, signed by<br />

the contractor and the departmental <strong>of</strong>ficer, responsibility regarding layout will be joint.<br />

4. AGENT AND WORK ORDER BOOK :<br />

4.1 The contractor shall himself engage an authorised all time agent on the work capable <strong>of</strong><br />

managing and guiding the work and understanding the specifications and contract conditions. A<br />

qualified and experienced Engineer shall be provided by the contractor as his agent for<br />

technical matters. Site engineer can also be designated as an agent <strong>of</strong> the contractor. Agent<br />

will take orders as will be given by the Executive Engineer or his representative and shall be<br />

responsible for carrying them out. This agent shall not be changed without prior intimation <strong>of</strong><br />

the Executive Engineer and his representative on the work site. The Engineer-in-charge have<br />

the unquestionable right to ask for changes in the quality and strength <strong>of</strong> supervisory staff <strong>of</strong><br />

contractor and to order removal from work <strong>of</strong> any <strong>of</strong> such staff. The contractor shall comply with<br />

such order and effect replacements <strong>of</strong> the satisfaction <strong>of</strong> the Engineer-in-charge.<br />

4.2 A work order book shall be maintained on site and it shall be the property <strong>of</strong><br />

Government and the contractor shall promptly sign orders given therein by the Executive<br />

Engineer or his representative and his superior <strong>of</strong>ficer, and comply with them. The compliance<br />

shall be reported by contractor to the Engineer in good time so that it can be checked, the blank<br />

work order book, with machine numbered pages will be provided by the Department free <strong>of</strong><br />

charge for this purpose. The contractor will be allowed to copy out the instruction therein from<br />

time to time.<br />

5. INITIAL MEASUREMENT OF RECORD:<br />

Where for proper measurements <strong>of</strong> the work it is necessary to have an initial set <strong>of</strong> levels or<br />

other measurements taken the same as recorded in the authorised field book or M.B. <strong>of</strong><br />

Government by the Engineer or his authorised representative will be signed by the contractor<br />

who will be entitled to have a true copy <strong>of</strong> same made at his cost. Any failure on the part <strong>of</strong> the<br />

contractor who will be entitled to have a true copy <strong>of</strong> same made at his cost. Any failure on the<br />

liable to accept the decision <strong>of</strong> the Engineer as to basis <strong>of</strong> taking measurements and will be<br />

subsequent measurement difficult or impossible without first getting the same jointly measured<br />

and recorded by himself and the authorised representative <strong>of</strong> the Engineer. The record <strong>of</strong> such<br />

measurement maintained by Government shall be signed by the contractor and he will be<br />

entitled to have a true copy <strong>of</strong> the same made at his cost.<br />

6. CUSTODY OF WORK:<br />

All work and materials before being finally taken over by Government will be the entire liability<br />

<strong>of</strong> the contractor for guarding, maintaining and making good any damages <strong>of</strong> any magnitude. It<br />
