Officer Recommendation
That the proponent of development application 17/2010 Mr Kevin Laundry be
advised on behalf of Messrs G & J Hawes of Lot 203 (131) Knight Terrace
Denham that;
a) It may favourably consider conditional approval for Development
Application 17/2010 after the Shire has finalised an amendment to its Town
Planning Scheme that allows it to vary the height provisions of
outbuildings on land subject to inundation.
OR
b) As Development Application 17/2010 does not comply with the provisions
of the Shire of Shark Bay Town Planning Scheme No. 3 and its pursuant
policies it be refused.

Reason For Change in Officer Recommendation Item 13.3
The Manager Regulatory Services has advised that the owners of Lot 203 (131) Knight
Terrace, Mr & Mrs Hawes have written to Council asking that the item be deferred to the
next Council meeting to allow for re-consideration and any amendments to the project.
The Change of Recommendation from the agenda is as follows:
Council Resolution
That Council defer the consideration of development application 17/2010 –
Outbuilding Size, Height and Floor Level Variations until the applicant has
reconsidered and made any amendments to the project.
