If this determination is made, the City shallestablish an exception process for disabled accessibility topermit development within the setback when it can bedetermined that such features will not be detrimental to thepublic welfare, injurious to other property, and that specialcircumstances exist that would deprive the property ownerof privileges enjoyed by other properties in the vicinity.
