TORTURE AND ILL-TREATMENT OF CHILDREN IN UKRAINE

Torture and ill-treatment of children in Ukrainehealth, protection of reputation or rights of others, in order to prevent the disclosureof information received in confidence, or for maintaining the authorityand impartiality of the justice;2) disclosure may cause substantial harm to those interests;3) the harm from disclosure of the information outweighs the public interestin getting it.Obviously, the public interest in obtaining the information necessary toconduct national research programs within the UN is not in doubt. One canonly guess, what is the real cause of failure of the management of the CMMof MIA of Ukraine to use formal grounds for refusal to provide information,the disclosure of which can in no way harm the society. Moreover, there is nodoubt that the work of units working with children should be as transparentto the public as possible.Under such circumstances, the study concerning the structure of personnelof the CMM units used only publicly available information.Last year the Ministry adopted two directives about the work of its departmentsworking with children, namely, the Regulations on Managementof Criminal Juvenile Militia of MIA of Ukraine (approved by the Order 20 ) andInstruction 21 .Under this Regulation the main task of the Office of CMM of Internal Affairsof Ukraine is to participate in the implementation of the state policy of protectingthe rights and interests of children, and its functions include the organizationand control, inside its competence, fulfillment by the units of criminal militiafor children of the laws of Ukraine concerning the activities of the juvenilejustice and legislation on the prevention of criminal and administrative offensesto combat crime in the children’s environment and tracing missing children.As to the new instruction for the units working with children in the absenceof the text of previous instruction (classified as confidential), whichregulated the activity of CMM units, we cannot compare its contents with thecontents of the new Instruction.
