(“JBI”), a North Carolina corporation.PREMISES1. The <strong>County</strong> is the owner of certain real property located in <strong>Cabarrus</strong> <strong>County</strong>,North Carolina, on which it has constructed and operates its Sheriff’s Administration Buildingand its Detention Center.2. JBI is the owner of certain real property the “Washington Square ApartmentsProperty” located in <strong>Cabarrus</strong> <strong>County</strong>, North Carolina, and being located adjacent to the Sheriff’sAdministration Building and Detention Center and being more particularly described in Exhibit Aattached and incorporated by reference.3. The <strong>County</strong> desires to construct a retaining wall on its property in order toprevent erosion from its property onto the Washington Square Apartments Property of JBI. Adrawing showing the location of the retaining wall is attached as Exhibit B and incorporated byreference.4. The <strong>County</strong> desires access across JBI’s Washington Square Apartments Propertyin order to construct, maintain and repair this retaining wall.In consideration of the above Premises, the Terms contained below and other good andvaluable consideration, the receipt and sufficiency of which are hereby acknowledged, the partiesagree as follows:1F-2Attachment number 1Page 57
