Attorney General's Office clarifies<br />

charges against Miles<br />

We have a clarification tonight from <strong>the</strong> Attorney General's<br />

Office after a Lake Charles man was charged with his 4th<br />

<strong>of</strong>fense DWI in Lafayette.<br />

29-year-old Alexander Miles remains in jail tonight in<br />

Lafayette on a $100,000 bond after police say he caused an<br />

accident Tuesday afternoon on Johnston Street. His blood<br />

alcohol level was allegedly .312, and he was on his way to<br />

rehab.<br />

Our investigative team began pulling court records and<br />

questioned why 29-year-old Alexander Miles was charged<br />

with both a 2nd <strong>of</strong>fense DWI and a 3rd <strong>of</strong>fense DWI for <strong>the</strong><br />

same traffic incident in March <strong>of</strong> 2013. The Attorney<br />

General's <strong>of</strong>fice is prosecuting this arrest because <strong>the</strong><br />

District Attorney's Office recused <strong>the</strong>mselves from <strong>the</strong> case (Miles is related to <strong>the</strong><br />

Calcasieu Parish District Attorney). The Attorney General's Office responded today, saying<br />

both <strong>of</strong> those charges do stem from <strong>the</strong> same incident.<br />

Essentially, Miles was charged for a 3rd <strong>of</strong>fense because it was his 3rd DWI arrest.<br />

However, he pled down to a misdemeanor charge for <strong>the</strong> first arrest, so he's only<br />

convicted <strong>of</strong> one DWI. This means <strong>the</strong> March 2013 case is being tried as a 2nd <strong>of</strong>fense<br />

DWI case, not a 3rd <strong>of</strong>fense as he was initially charged.<br />

He's scheduled to go to trial for <strong>the</strong> 2nd <strong>of</strong>fense DWI charge in Lake Charles next week. If<br />

convicted in that case, it would mean he would face a 3rd <strong>of</strong>fense charge in Lafayette, not<br />

<strong>the</strong> 4th <strong>of</strong>fense as initially charged.<br />
