§133. Filing or maintaining false public records<br />

A. Filing false public records is <strong>the</strong> filing or depositing for record in any public <strong>of</strong>fice or<br />

with any public <strong>of</strong>ficial, or <strong>the</strong> maintaining as required by law, regulation, or rule, with<br />

knowledge <strong>of</strong> its falsity, <strong>of</strong> any <strong>of</strong> <strong>the</strong> following:<br />

(1) Any forged document.<br />

(2) Any wrongfully altered document.<br />

(3) Any document containing a false statement or false representation <strong>of</strong> a material fact.<br />

B. The good faith inclusion <strong>of</strong> any item <strong>of</strong> cost on a Medical Assistance Program cost<br />

report which is later determined by audit to be non-reimbursable under state and federal<br />

regulations shall be an affirmative defense to a violation <strong>of</strong> this Section.<br />

C.(1) Whoever commits <strong>the</strong> crime <strong>of</strong> filing false public records shall be imprisoned for<br />

not more than five years with or without hard labor or shall be fined not more than five thousand<br />

dollars, or both.<br />

(2) In addition to <strong>the</strong> penalty provided for in Paragraph (1) <strong>of</strong> this Subsection, a person<br />

convicted <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> this Section may be ordered to pay restitution to <strong>the</strong> state if <strong>the</strong><br />

state suffered a loss as a result <strong>of</strong> <strong>the</strong> <strong>of</strong>fense. Restitution shall include <strong>the</strong> payment <strong>of</strong> legal<br />

interest at <strong>the</strong> rate provided in R.S. 13:4202.<br />

§126.2. False statements concerning denial <strong>of</strong> constitutional rights<br />

A. No person shall wilfully and knowingly, whe<strong>the</strong>r orally or in writing, make or cause<br />

to be made to any agency, board, commission, member, <strong>of</strong>ficer, <strong>of</strong>ficial, appointee, employee or<br />

representative <strong>the</strong>re<strong>of</strong>, <strong>of</strong> <strong>the</strong> executive, legislative, or judicial department <strong>of</strong> <strong>the</strong> United States or<br />

any subdivision <strong>the</strong>re<strong>of</strong>, which may be now in existence, or who may be now appointed, or<br />

hereafter created or appointed, including but not limited to any commissioner, referee, or voting<br />

referee now appointed or who may be hereafter appointed by any court <strong>of</strong> <strong>the</strong> United States or<br />

any judge <strong>the</strong>re<strong>of</strong>, and fur<strong>the</strong>r including but not limited to any member <strong>of</strong> <strong>the</strong> Federal Bureau <strong>of</strong><br />

Investigation and any agent or representative, investigator, or member <strong>of</strong> <strong>the</strong> Commission <strong>of</strong><br />

Civil Rights <strong>of</strong> <strong>the</strong> United States, or <strong>the</strong> Advisory Committee or Board <strong>of</strong> <strong>the</strong> Commission <strong>of</strong><br />

Civil Rights <strong>of</strong> <strong>the</strong> United States appointed in and for <strong>the</strong> state <strong>of</strong> Louisiana, any false or<br />

fictitious or fraudulent statement or statements, or to use any false writing or document asserting<br />

or claiming that such person or persons, or any o<strong>the</strong>r person or persons have been or are about to<br />

be denied or deprived <strong>of</strong> any right, privilege, or immunity granted or secured to <strong>the</strong>m, or to any<br />

<strong>of</strong> <strong>the</strong>m, by <strong>the</strong> United States Constitution and laws, or by <strong>the</strong> Louisiana Constitution and laws,<br />

by any <strong>of</strong>ficer, agency, employee, representative, board or commission or any member <strong>the</strong>re<strong>of</strong> <strong>of</strong><br />

<strong>the</strong> state <strong>of</strong> Louisiana, or <strong>of</strong> any parish or municipality <strong>of</strong> <strong>the</strong> state <strong>of</strong> Louisiana, or <strong>of</strong> any o<strong>the</strong>r<br />

political subdivision <strong>of</strong> <strong>the</strong> state <strong>of</strong> Louisiana, or by <strong>the</strong> state <strong>of</strong> Louisiana.<br />

B. Any person or persons violating <strong>the</strong> provisions <strong>of</strong> this Section shall, upon conviction<br />

<strong>the</strong>re<strong>of</strong>, be punished by imprisonment for not less than one year nor more than five years with or<br />

without hard labor, or by a fine <strong>of</strong> not less than one hundred dollars nor more than one thousand<br />

dollars or by both such fine and imprisonment.<br />
