PART V. ELECTIONS COMPLIANCE UNIT<br />

§49.1. Elections compliance unit; powers and duties<br />

A. An elections compliance unit is created in <strong>the</strong> Department <strong>of</strong> State. The purposes <strong>of</strong><br />

<strong>the</strong> unit shall be to:<br />

(1) Initiate independent inquiries and conduct independent investigations into allegations<br />

<strong>of</strong> election irregularities in any municipality or parish <strong>of</strong> <strong>the</strong> state.<br />

(2) Respond to notifications or complaints alleging election irregularities generated by<br />

election <strong>of</strong>ficials or any o<strong>the</strong>r person.<br />

(3) Review notices and reports <strong>of</strong> election irregularities and conduct investigations <strong>of</strong><br />

any incidents that it determines require fur<strong>the</strong>r investigation.<br />

B. For purposes <strong>of</strong> investigation, <strong>the</strong> elections compliance unit shall have <strong>the</strong> authority<br />

to:<br />

(1) Issue subpoenas to compel <strong>the</strong> production <strong>of</strong> records and o<strong>the</strong>r documents from any<br />

registrar <strong>of</strong> voters.<br />

(2) Receive sworn statements.<br />

C. Notwithstanding any o<strong>the</strong>r provision <strong>of</strong> law to <strong>the</strong> contrary, a member <strong>of</strong> <strong>the</strong> Elections<br />

Compliance Unit, upon <strong>the</strong> receipt <strong>of</strong> a complaint <strong>of</strong> any election irregularity, may enter a<br />

polling place during early voting or on election day for <strong>the</strong> purposes <strong>of</strong> checking <strong>the</strong> overall<br />

operations <strong>of</strong> <strong>the</strong> polling place or investigating any potential violation <strong>of</strong> <strong>the</strong> Louisiana Election<br />

Code.<br />

D. If during <strong>the</strong> course <strong>of</strong> investigation, <strong>the</strong> elections compliance unit determines that<br />

<strong>the</strong>re may be a violation <strong>of</strong> any criminal law or provision <strong>of</strong> <strong>the</strong> Louisiana Election Code, <strong>the</strong><br />

findings <strong>of</strong> <strong>the</strong> investigation shall be turned over to <strong>the</strong> appropriate prosecutorial agency for<br />

fur<strong>the</strong>r investigation or prosecution.<br />

Please provide copies <strong>of</strong> all Notice <strong>of</strong> Election and Ballots in compliance with Louisiana Revised<br />

Statute 33:4344, in regards to <strong>the</strong> election on March 28, 2015. Please provide copies <strong>of</strong> all<br />

notifications published in <strong>the</strong> “Calcasieu Parish Official Journal.” If <strong>the</strong>re is no “Official<br />

Journal,” <strong>the</strong>n provide copies <strong>of</strong> all newspaper published election notices for <strong>the</strong> March 28, 2015<br />

election.<br />

Please provide copies <strong>of</strong> <strong>the</strong> Petition for Election in compliance with Louisiana Revised<br />

Statute 3:3008 in regards to <strong>the</strong> March 28, 2015 election. In addition, please provide copies <strong>of</strong><br />

o<strong>the</strong>r public notices <strong>of</strong> elections in compliance with Louisiana Revised Statute 3:3008.<br />

Please provide a copy <strong>of</strong> <strong>the</strong> written notice <strong>of</strong> <strong>the</strong> election and <strong>the</strong> certificate that is required by<br />

Louisiana Revised Statute 18:1285 Subparagraph (b). In addition, please include <strong>the</strong> date it was<br />

transmitted to <strong>the</strong> Secretary <strong>of</strong> State and Registrar <strong>of</strong> Voters Office.<br />

Please include any Calcasieu Parish written policies and procedures in regards to public election<br />

notices. Please include when information such as a sample ballot is made available on <strong>the</strong><br />

Calcasieu Parish Clerk <strong>of</strong> Court website.
