Dear Public Records Request Officers,<br />

This is a request under <strong>the</strong> Louisiana Public Records Act. Section 44:32(D) <strong>of</strong> <strong>the</strong> Louisiana Public Records Act<br />

requires a response within three business days.<br />

I request that a copy <strong>of</strong> <strong>the</strong> following documents [or documents containing <strong>the</strong> following information] be<br />

provided:<br />

1. Please State <strong>the</strong> Federal and Louisiana laws that provide prosecutors or law enforcement<br />

employees some protection from liability <strong>of</strong> malicious prosecution.<br />

2. Prosecutors who bring cases without adequate justification and <strong>the</strong>ir conspirators or accomplices<br />

carrying out vendettas such as fire inspectors, media outlets, or o<strong>the</strong>r agencies acting outside<br />

jurisdictions may be sued for doing so, and are not protected by “prosecutorial immunity” if <strong>the</strong><br />

prosecutors' actions were egregious. Please state any claims from any persons that made claims <strong>of</strong><br />

Malicious Prosecutions involving <strong>the</strong> Calcasieu Parish District Attorney’s Office since 2005 to<br />

present.<br />

3. Malicious prosecution refers to a criminal or civil case that is filed without an adequate basis and<br />

for an improper purpose, such as harassing a defendant, ruining ano<strong>the</strong>r person’s reputation, or to<br />

knowingly place blame on someone o<strong>the</strong>r than <strong>the</strong> actual wrongdoer. Please state any settlement<br />

agreements or financial damages paid by <strong>the</strong> Calcasieu Parish District Attorney’s Office for<br />

malicious prosecution from 2005 to present.<br />

4. Have <strong>the</strong>re been any claims against <strong>the</strong> Calcasieu Parish District Attorney’s Office that any<br />

employee or prosecutor abused <strong>the</strong> legal process and abused his authority as a prosecutor?<br />

Possible claims could be for damages such as being jailed, cost <strong>of</strong> defending charges, lost business<br />

due to missed work, damage’s to reputations in <strong>the</strong> community?<br />
