SUBJECT: Buy American Act<br />

Fact Sheet<br />
Purpose. To inform the Garrison Commander about the constraints imposed by the Buy<br />
American Act should Fort Riley decide to purchase new cargo trucks for DOL.<br />
Discussion.<br />
· Federal Acquisition Regulation (FAR) 97-05 requires that only domestic end products be<br />
acquired for public (Federal) use.<br />
· FAR 97-05 definitions:<br />
- “Components” means those articles, materials, and supplies incorporated directly into<br />
the end products.<br />
- “Domestic end product” means an end product manufactured in the United States and<br />
the cost of its components mined, produced, or manufactured in the United States<br />
exceeds 50 percent of the cost of all its components.<br />
- “End product” means those articles, materials, and supplies to be acquired for public<br />
use under the contract.<br />
- “United States” means the United States, its possessions, territories, and any other<br />
place subject to its jurisdiction, but does not include leased bases or trust territories.<br />
· Paragraph 25.102, FAR 97-05, lists exceptions; however, none apply to the purchase of<br />
cargo trucks for Fort Riley’s DOL.<br />
Conclusion. Should Fort Riley decide to purchase new vehicles next month, the cost of the<br />
US-made components in the vehicle must be at least 50 percent of the total cost of the<br />
components.<br />
