A.10.3 St<strong>at</strong>e-Specific Discussion of Financial Assurance Requirements<br />

Illinois—Financial assurance may be provided for landfills in Illinois by a trust<br />

agreement, a bond guaranteeing payment, a bond guaranteeing either payment or performance, a<br />

letter of credit, insurance, or self-insurance (35 Ill. Adm. Code 811.700).<br />

Illinois regul<strong>at</strong>ions do not specify financial assurance requirements for surface<br />

impoundments, but if a surface impoundment will be closed with waste in place, the regul<strong>at</strong>ory<br />

agency may decide on a case-specific basis to include financial assurance requirements in the<br />

NPDES or construction/oper<strong>at</strong>ing permits.<br />

Indiana—All solid waste land disposal facilities th<strong>at</strong> are required to have solid waste<br />

disposal permits in Indiana must provide financial responsibility for implementing closure and<br />

post-closure requirements (329 IAC 10-39-1). The Indiana regul<strong>at</strong>ions exclude ash ponds th<strong>at</strong><br />

receive w<strong>at</strong>er-transported coal ash from the requirement to have solid waste disposal permits<br />

(329 IAC 10-3-1(8)). Accordingly, such surface impoundments are not subject to the financial<br />

assurance requirements th<strong>at</strong> apply to solid waste disposal facilities. The Indiana regul<strong>at</strong>ions do<br />

not specify financial assurance requirements for surface impoundments th<strong>at</strong> receive other types<br />

of CCWs.<br />

Pennsylvania—Regul<strong>at</strong>ions provide minimum requirements for demonstr<strong>at</strong>ing sufficient<br />

financial responsibility for the oper<strong>at</strong>ion of residual waste processing or disposal facilities by<br />

providing for bond guarantees for the oper<strong>at</strong>ion of the facilities, and by providing for minimum<br />

standards for insurance protection for personal injury and property damage to third parties<br />

arising from the oper<strong>at</strong>ion of those facilities (25 Pa. Code 287.301 through 287.375).
