waste landfill regul<strong>at</strong>ions in 1988, many coal combustion<br />

by-product landfills in the St<strong>at</strong>e, including three <strong>at</strong> power<br />

plants owned by the company, requested variances from the<br />

section(s) in the regul<strong>at</strong>ions requiring testing for organic<br />

constituents during Phase II monitoring. Also, groundw<strong>at</strong>ermonitoring<br />

d<strong>at</strong>a collected after 1988 but before the variance<br />

was granted demonstr<strong>at</strong>ed th<strong>at</strong> no semivol<strong>at</strong>ile organic<br />

compounds, pesticides, polychlorin<strong>at</strong>ed biphenyls, or vol<strong>at</strong>ile<br />

organic compounds other than carbon disulfide, which can<br />

occur n<strong>at</strong>urally, were detectable <strong>at</strong> the landfill site.<br />

the letter approving the variance: “variance is justified because<br />

the facility is a coal ash landfill and not likely to contain and<br />

release organic constituents, and because organic constituents<br />

have been tested for, but not detected.”<br />
