When re solv ing the amparo claim, the Col le giate Court af firmed that the au thor i ties of the Mex i can State were forced to re solve any de fects of in di - rect un con sti tu tion al ity raised due to the il le gal acts and au thor ity pro ce - dures by vir tue of ad min is tra tive ir reg u lar i ties re sult ing from the non-ob - ser vance of an in ter na tional treaty, as set forth by the Con sti tu tion in so far as the in ter na tional trea ties en tered into by the Mex i can State —inter alia the hu man rights trea ties— form part of the Su preme Law. Con se quently, the Col le giate Court es tab lished that the state courts shall not be lim ited to ap ply ing only the laws but the state courts must use, inter alia, any in - ter na tional trea ties and con ven tions and the ju ris pru dence is sued by the Inter-Amer i can Court of Hu man Rights, apart from those from other bod - ies. There fore, they must con trol con ven tion al ity be tween the do mes tic le - gal rules and the su pra na tional le gal rules. The Col le giate Court pointed out that due to the con trol of con ven tion al ity, they must ex am ine the rules (ma te rial rules) of the do mes tic law with an in ter na tional rule, re gard ing any in ter na tion ally il licit facts (ac tion or omis sion) to pre serve and guar - an tee the ex er cise of hu man rights. Ac cord ing to the above, the Col le giate Court es tab lished that when ever a con flict arises re gard ing these rights, the trea ties signed by the Mex i can State reg u lat ing them must be placed at the level of the Con sti tu tion be cause such in ter na tional in stru ments are an ex ten sion of the Con sti tu tion pro vi sions re gard ing fun da men tal rights. Like wise, the Col le giate Court pointed out that since all the pro vi sions of in ter na tional trea ties are au to mat i cally in tro duced in the do mes tic law, any in ter na tional com mit ments are un der taken by the Mex i can State as a whole and they en gage all the State au thor i ties —both at fed eral and at lo cal lev els— vis-à-vis the in ter na tional com mu nity. To that end, the Col - le giate Court con firmed that once the in ter na tional trea ties re gard ing hu - man rights have been in tro duced to the Su preme Law, and given the rec - og ni tion of the con ten tious com pe tence of the Inter-Amer i can Court, it is pos si ble to ap ply the ju ris pru dence of such court as a guid ing cri te ria when ever there is a mat ter of in ter pre ta tion of and com pli ance with the pro vi sions re gard ing hu man rights. Lastly, it es tab lished that the pro homine prin ci ple must be taken into ac count as her me neu tic cri te ria whereby the broad est rule or the most com pre hen sive in ter pre ta tion must be ap plied in any hu man rights cases. On the con trary, the most re stric - 13

In this de ci sion, the Col le giate Court re ferred to the sen tence ren dered by the Inter-Amer i can Court of Hu man Rights in the case Almonacid Arellano et al. v. Chile, re gard ing the con trol of con ven tion al ity.
