63. Committing any <strong>of</strong>fense that is a state-mandated expellable <strong>of</strong>fense if the <strong>of</strong>fense is committed on the<br />

property <strong>of</strong> another district in Texas or while the student is attending a school-sponsored or school<br />

related activity <strong>of</strong> a school in another district in Texas.<br />

Federal Firearms Act<br />

<strong>YES</strong> <strong>Prep</strong> <strong>Public</strong> <strong>Schools</strong>, as an open-enrollment charter school, shall expel a student who brings a firearm, as<br />

defined by 18 U.S.C. Section 921, to school. The student must be expelled from the student's regular campus<br />

for a period <strong>of</strong> at least one year, except that the superintendent or other chief administrative <strong>of</strong>ficer <strong>of</strong> the<br />

school may modify the length <strong>of</strong> the expulsion in the case <strong>of</strong> an individual student.<br />

Restrictions During Expulsion<br />

Expelled students are prohibited from being on school grounds or attending school-sponsored or schoolrelated<br />

activities during the period <strong>of</strong> expulsion.<br />

Newly Enrolled Students<br />

<strong>YES</strong> <strong>Prep</strong> will decide on a case-by-case basis the placement <strong>of</strong> a student who is subject to an expulsion order<br />

from another district or an open-enrollment charter school upon enrollment in the district.<br />

Discipline <strong>of</strong> Students with Disabilities<br />

The discipline <strong>of</strong> students with disabilities is subject to applicable state and federal law in addition to the <strong>YES</strong><br />

<strong>Prep</strong> Handbook. To the extent any conflict exists, state and/or federal law will prevail.<br />

Suspension and Expulsion as Consequences for Serious and/or Persistent Misbehaviors<br />

A student may be suspended and/or expelled for serious infractions. Misbehaviors in violation <strong>of</strong> the Student<br />

Code <strong>of</strong> Conduct not otherwise constituting an expellable <strong>of</strong>fense may become a serious infraction subject to<br />

expulsion and/or suspension when the misbehavior is so persistent that, in cumulative effect, it is significantly<br />

disruptive <strong>of</strong> the educational process. The decision to expel shall be based on an assessment <strong>of</strong> the facts and<br />

circumstances <strong>of</strong> each case. Relevant factors, without prioritization, include, but are not limited to, the<br />

seriousness <strong>of</strong> the misconduct, the student's age, grade level, history <strong>of</strong> prior misconduct, health and safety<br />

issues, and disruptive effects upon the educational process. If a student is expelled from <strong>YES</strong> <strong>Prep</strong> <strong>Public</strong><br />

<strong>Schools</strong> and wishes to return at the end <strong>of</strong> the expulsion period, s/he will be required to re-apply to <strong>YES</strong> <strong>Prep</strong><br />

and participate in the lottery system as appropriate. Additionally, any expelled student will not have the<br />

benefit <strong>of</strong> a sibling preference in the lottery system.<br />

Suspension Process<br />

In addition to the above list <strong>of</strong> serious violations, the principal/school director or designee has the authority to<br />

suspend a student for a period <strong>of</strong> up to 10 school days for any <strong>of</strong> the following additional reasons:<br />

The need to further investigate an incident;<br />

A recommendation to expel the student; or<br />
