The resident experienced daily or less than daily discomfort with no compromise<br />

in physical, mental, or psychosocial functioning as a result <strong>of</strong> the facility‘s failure<br />

to adequately recognize or address the situation, or failure to develop, implement,<br />

monitor, or modify a pain management plan to try to meet the resident‘s needs; or<br />

The resident experienced minimal episodic pain or discomfort (that was not<br />

significant pain) related to care/treatment, as a result <strong>of</strong> the facility‘s failure to<br />

develop, implement, monitor, or modify a pain management plan.<br />

Severity Level 1: No actual harm with potential for no more than minimal harm for<br />

a resident with pain or potential for pain.<br />

The failure <strong>of</strong> the facility to provide appropriate care <strong>and</strong> services for pain management<br />

places the resident at risk for more than minimal harm. Therefore, Severity Level 1 does<br />

not apply for this regulatory requirement.<br />

§483.25(a) Activities <strong>of</strong> Daily Living.<br />

Based on the comprehensive assessment <strong>of</strong> a resident, the facility must ensure that<br />

The intent <strong>of</strong> this regulation is that the facility must ensure that a resident‘s abilities in<br />

ADLs do not deteriorate unless the deterioration was unavoidable.<br />

§483.25(a)(1) A resident’s abilities in activities <strong>of</strong> daily living do not diminish unless<br />

circumstances <strong>of</strong> the individual’s clinical condition demonstrate that diminution was<br />

unavoidable. This includes the resident’s ability to --<br />

(i) Bathe, dress, <strong>and</strong> groom;<br />

(ii) Transfer <strong>and</strong> ambulate;<br />

(iii) Toilet;<br />

(iv) Eat; <strong>and</strong><br />

(v) Use speech, language, or other functional communication systems.
