ii. Each resident is <strong>of</strong>fered an pneumococcal immunization, unless the immunization<br />

is medically contraindicate or the resident has already been immunized;<br />

iii. The resident or the resident’s legal representative has the opportunity to refuse<br />

immunization; <strong>and</strong><br />

iv. The resident’s medical record includes documentation that indicates, at a<br />

minimum, the following:<br />

Intent:<br />

(A) That the resident or resident’s legal representative was provided education<br />

regarding the benefits <strong>and</strong> potential side effects <strong>of</strong> pneumococcal<br />

immunization; <strong>and</strong><br />

(B) That the resident either received the pneumococcal immunization or did not<br />

receive the pneumococcal immunization due to medical contraindication or<br />

refusal.<br />

v. Exception. As an alternative, based on an assessment <strong>and</strong> practitioner<br />

recommendation, a second pneumococcal immunization may be given after 5<br />

years following the first pneumococcal immunization, unless medically<br />

contraindicated or the resident or the resident’s legal representative refuses the<br />

second immunization.<br />

The intent <strong>of</strong> this requirement is to:<br />

Minimize the risk <strong>of</strong> residents acquiring, transmitting, or experiencing complications from<br />

influenza <strong>and</strong> pneumococcal pneumonia by assuring that each resident:<br />

o Is informed about the benefits <strong>and</strong> risks <strong>of</strong> immunizations; <strong>and</strong><br />

o Has the opportunity to receive, unless medically contraindicated or refused or already<br />

immunized, the influenza <strong>and</strong> pneumococcal vaccine; <strong>and</strong><br />

Assure documentation in the resident‘s medical record <strong>of</strong> the information/education provided<br />

regarding the benefits <strong>and</strong> risks <strong>of</strong> immunization <strong>and</strong> the administration or the refusal <strong>of</strong> or<br />

medical contraindications to the vaccine(s).<br />

Definitions<br />

Medical contraindication – A condition or risk that precludes the administration <strong>of</strong> a treatment or<br />

intervention because <strong>of</strong> the substantial probability that harm to the individual may occur.<br />

Precaution - A condition in a potential recipient that might increase the risk for a serious adverse<br />

reaction or that might compromise the vaccine‘s induction <strong>of</strong> immunity. However, the risk for<br />

this happening is less than expected with a contraindication. For example, as a result <strong>of</strong> the<br />

resident‘s condition, complications could result, or a person might experience a more severe
