§483.75(e)(7) Required retraining<br />

If, since an individual’s most recent completion <strong>of</strong> a training <strong>and</strong> competency<br />

evaluation program, there has been a continuous period <strong>of</strong> 24 consecutive months<br />

during none <strong>of</strong> which the individual provided nursing or nursing-related services<br />

for monetary compensation, the individual must complete a new training <strong>and</strong><br />

competency evaluation program or a new competency evaluation program.<br />

Interpretive Guidelines: §483.75(e)(7)<br />

If an individual does not wish to be retrained, the individual must establish that he or she<br />

performed nursing or nursing-related services for monetary compensation for at least one<br />

documented day (i.e., 8 consecutive hours) during the previous 24 months. The State is<br />

required to remove the individual‘s name from the registry if the services are not<br />

provided for monetary compensation during the 24-month period. Thus, in the absence<br />

<strong>of</strong> any evidence to the contrary, you can assume that the retraining requirement does not<br />

apply to an individual whose name appears on the registry.<br />

Section 6121 <strong>of</strong> the Patient Protection <strong>and</strong> Affordable Care Act (PPACA) <strong>of</strong> 2010,<br />

amending Sections 1819(f)(2)(A)(i)(I)) <strong>and</strong> 1919(f)(2)(A)(i)(I) <strong>of</strong> the Social Security Act,<br />

clarifies that nurse aide training includes initial <strong>and</strong> annual dementia management <strong>and</strong><br />

patient abuse prevention training for all nurse aides.<br />

§483.75(e)(8) Regular In-Service Education<br />

The facility must complete a performance review <strong>of</strong> every nurse aide at least once<br />

every 12 months, <strong>and</strong> must provide regular in-service education based on the<br />

outcome <strong>of</strong> these reviews. The in-service training must--<br />

(i) Be sufficient to ensure the continuing competence <strong>of</strong> nurse aides, but must be<br />

no less than 12 hours per year;<br />

(ii) Address areas <strong>of</strong> weakness as determined in nurse aides’ performance<br />

reviews <strong>and</strong> may address the special needs <strong>of</strong> residents as determined by the<br />

facility staff; <strong>and</strong><br />

(iii) For nurse aides providing services to individuals with cognitive<br />

impairments, also address the care <strong>of</strong> the cognitively impaired.
