7 too, represent the Plaintiffs in this case. The
8 questions I'm going to ask you deal less with your
9 specific opinion and more with how you arrived at those
10 opinions. Do you understand that I'm kind of making a
11 shift in the way we are looking at these questions?

13 Q Okay. You have made certain statements during
14 the deposition that you were not hired to present an
15 opinion on certain issues. Can you kind of explain to
16 the jury what opinion you were hired to present?
17 A What the franchise relationship is and was
18 between American Dairy Queen and its franchisees
19 particularly in this case with Tyler Matthews and the
20 issue of playgrounds as - as whether or not it is part
21 of their relationship.
22 Q So, you are going to explain the
23 franchisor-franchisee relationship and then specifically
24 how that exists - that relationship existed in the case
25 of Tyler Matthews; is that fair?
