I. Background<br />

A. Introduction and Overview <strong>of</strong> Value-Based Purchasing<br />

On March 23, 2010, the Patient Protection and Affordable Care Act<br />

(Pub. L. 111-148) was enacted. Following the enactment <strong>of</strong> Pub. L. 111-148, the Health<br />

Care and Education Reconciliation Act <strong>of</strong> 2010 (Pub. L. 111-152) (enacted on<br />

March 30, 2010), amended certain provisions <strong>of</strong> Pub. L. 111-148. These public laws are<br />

collectively known as the Affordable Care Act. The Affordable Care Act includes a<br />

number <strong>of</strong> provisions designed to improve the quality <strong>of</strong> Medicare services, support<br />

innovation and the establishment <strong>of</strong> new payment models in the program, better align<br />

Medicare payments with provider costs, strengthen program integrity within Medicare,<br />

and put Medicare on a firmer financial footing.<br />

With respect to quality improvement, the Affordable Care Act includes provisions<br />

to expand value-based purchasing, broaden quality reporting, improve the level <strong>of</strong><br />

performance feedback available to suppliers, create incentives to enhance quality,<br />

improve beneficiary outcomes, and increase the value <strong>of</strong> care.<br />

Value-based purchasing is a concept that links payment directly to the quality <strong>of</strong><br />

care provided and is a strategy that can help transform the current payment system by<br />

rewarding providers for delivering high quality, efficient clinical care. We have<br />

significant experience in developing, refining, and expanding health care quality<br />

performance measures through our experience with value-based demonstration efforts,<br />

noting some <strong>of</strong> these efforts later in the document, and various Medicare payment
