and minimum attainment level and establishes a point scale for certain measures. Contingent<br />

upon data availability, quality measure performance benchmarks are defined by CMS based on<br />

Medicare fee-for-service, MA, or <strong>ACO</strong> performance data.<br />

(i) For the first performance period under the Shared Savings Program, CMS defines the<br />

quality performance standard at the level <strong>of</strong> complete and accurate reporting.<br />

(ii) For all subsequent years, CMS defines the quality performance based on measure<br />

scores.<br />

(2) Performance below the minimum attainment level will receive zero points for that<br />

measure, for those measures in which the points scale applies.<br />

(3) Performance equal to or greater than the minimum attainment level but less than the<br />

performance benchmark must receive points on a sliding scale based on the level <strong>of</strong><br />

performance, for those measures in which the points scale applies.<br />

(4) Those measures designated as all or nothing measures receive the maximum<br />

available points if all criteria are met and zero points if at least one <strong>of</strong> the criteria are not met.<br />

(c) Methodology for calculating a performance score for each domain. CMS designates<br />

quality performance standards for each domain's contribution to an overall <strong>ACO</strong> performance<br />

score.<br />

(d) Shared savings eligibility. If the <strong>ACO</strong> demonstrates to CMS that it has satisfied the<br />

quality performance requirements for each domain, the requirements <strong>of</strong> §425.7 are satisfied, and<br />

the <strong>ACO</strong> meets all other applicable requirements, the <strong>ACO</strong> is eligible for shared savings. To<br />

satisfy the quality performance requirements for a domain:<br />

(1) The <strong>ACO</strong> must report all measures within a domain, via the mechanisms determined<br />

by CMS, in order to be considered for shared savings for that domain.
